Are you in possession of this upper on a fully built lower? That's SBR territory buddy...

      A few things.

It's brake not break. Second it's either a Flash Suppressor, or a Muzzle Brake.

Unless you have a legal means to posses a short barrel upper, it would not be legal for you to acquire a less then 16" barrel. You would have to have a muzzle device permanently attached before coming into your possession if you do not have a legal means or possessing it.

                They sell them both ways.
A lot of people in free states have sbr's or want to assemble the upper themselves before the pin/weld job.

True. Had a brainfart on that and looked at the website. For some reason I thought there was the drop-down that made you choose a device before adding to cart with uppers.

Yes I know that and it's not attached to any lowers nor does it have a BCG in it.

Thanks for clearing that up for me and explaining the difference between the 2 attachments.

Thank you, I will send you a PM today. I purchased the upper from a member here and he's going to ship it out today or tomorrow so I should have it next week.

just for your info, it doesn't have to attached to a lower to create an SBR violation. Just having a <16" upper if you possess any rifle lowers and you don't have any pistol lowers. Its called "constructive possession" and it means that they can charge you for having an SBR if you merely have the parts to make an SBR, even if you don't actually have it assembled.

Do you want an AOW or C&R SBS/SBR in CA?

Read upon what constitutes "constructive possession" under federal law.
Having "control" of a short barrel and a rifle lower receiver and NOT also having control of a pistol or NFA registered lower is all it takes to be in violation of the Feds...
It does not matter if its assembled.
