Just got an SKS for Christmas

Hey Cgunners,

My uncle recently gave me an unmodified Norinco SKS with a spiked bayonet for my graduation/christmas present. My question is do I need to register the long gun under my name? and my other uncles were saying that the bayonet on the sks is illegal is that true as well? If I do need it in my name does my uncle need to be present when I do the transfer? Any help on this would be greatly appreciated!

Long guns don't require registration, to my knowledge the bayonet is legal, and the transfer would just be a ten day wait for a background check. Your uncle does need to be there, but I would just.....

(finishing strangerdude's sentence)..take the gun and your uncle to a local FFL01 and do a legitimate PPT. If it were your father or grandfather, you could do an inter-family transfer but since it is from your uncle, PPT at an FFL01 as far as I know.

Bayonets are not considered an evil feature in California unless there was some special regs that I am not aware of (as there were for SKS specifically in the 94' AWB). I am sure someone with more knowledge will chime in about that soon.

Intra family transfer does not require ffl, just print out intra family transfer from doj, complete form, and send a $20 check with it.

Intra family transfer is good for transfer between, parent, child or grandparent only, uncle does not count, must go through PPT.

DOJ will reject it if it does meet the proper regs. I told this to a co worker recently, a local gun shop told him that I was wrong, go ahead and send in the form, he did, it was rejected, told ya so, I said quietly.

Congratulations TNP! I also acquired recently an unfired Norinco SKS through trade with a great fellow Calgunner. The only feature that I am aware that will give you problems is if you have the grenade launcher attachment on the SKS, bayonet/spike is standard on most SKS's. I can assure you that you won't have any problems with getting the transfer done as long as your uncle is present, you find a willing FFL and are okay with their charges. Due to our work schedule, We went to Big 5 Sporting goods to do the PPT (Yes, Big 5 does only long guns for PPT) for $35.00 (Cheapest I found too). I do warn you that the staff at Big 5 can be very rude to you if you show up with the rifle in the case with no cable lock on it. The guy helping us out was being a total *** when fellow Calgunner opened the case to present rifle and saw it had no lock. He loudly told us we had to leave the store and come back with a cable lock on it before they would do the transfer. I apologized to the guy and asked if I could buy a lock immediately from the store to put on. The situation got more tense as he was looking over assualt weapons checklist (Had no clue about SKS features) and Calgunner tried to help him out and explain him the flow chart while he still gave us an attitude. Little did Mr. Smartass know that fellow Calgunner was a very knowledgable LEO, who didn't have a problem letting him know he didn't appreciate the treatment we received and for the guy to question him if the rifle was legal. Let's just say the transfer went smoothly there after from that point on. Anyways, Good luck with the rifle and post up some pictures to share. Happy Holidays!

Big 5 does only long guns for PPT for $35.00 (Cheapest I found too)...

$35 is the max a FFL is legally allowed to charge for a PPT (It's the out of state transfers that are the expensive ones)

And to reiterate what others have said... yes you must do the transfer at a FFL and wait the 10 days. Inter-familial only applies to parent-child or grandparent-grandchild.

Is it a must that he be there when the transfer goes down? We live in different cities, and the guy I talked to on the phone from the local gun store said I could do it without him. Just want some clarification. Thanks guys!!

No. Up and down. Uncle could give it to grandpa who could give it to grandson. But no side ways such as brother to brother. Its known as the perilous work-around and is not advised.
