Ok. If I get a tax stamp and purchase and leave in a "free" state (parents live in fla) is that kosher? Or as a CA resident is that still a no go? On a similar vein how do out of state gun purchases work? Can I purchase a non Cali legal rifle out of state and leave it there? Before you ask no my parents can't be bothered to buy this stuff for me to play with when I visit.

I believe you have to be a permanent resident of the state in which you register your NFA item. In other words, I'm pretty sure you cant be a CA resident and register an NFA in FL (unless maybe you have a FL trust? Dunno). As for non-NFA but illegal CA weapons, you can purchase those from the state of your residence (or have an FFL transfer it to state residence) and keep them in the free state, or buy them here and reconfigure them to non-CA compliance once out of state and leave them there.
If you take NFA items across state lines, then you must inform the ATF of the transfer, AND make sure it is legal in the states which you are going to. However, I did read something about a "right to transfer/right of passage" if you HAVE to drive through a state to get to your destination.....it is likely legal to go into the state that it is illegal to own or use them in, but only so far as traveling or passing through it.....you CANNOT use the NFA items or do anything with them other than just pass through the state. Not 100% on this though.....check yourself before you wreck yourself
I feel like I am not answering your question appropriately....Last edited by goodlookin1; 10-24-2012, 8:36 AM. -
No I don't have a FL trust. My legal residence and everything is CA. My parents are only in FL on a transient stay (a long 12 year stay but they are moving back soon). I considered setting up FL residence for tax purposes but there was something distasteful about that. I was worried that was the case. Oh we'll. so much for that bright ideaComment

Get a driver's license for Florida and use the address of where your parents are staying. My buddy has relatives in Oregon and he got a State issued ID with no problem. He buys NFA stuff all the time and keeps them in Oregon, even though he's a permanent resident of California.Comment

I understand the "work around" of getting an out of state ID but does that make it "legal" by the book? Just because of the stakes were anything to come up this can't be gray area. If it says my state of permanent residence in the NFA laws....or just of "a residence"Comment

I have this covered. What you need is a trust with your parents and yourself listed as co-members. Your parents will purchase and DROS the suppressor in FL and leave it there. If you take a vacation to Nevada and want to go shooting your parents can send it to NEVADA (not California) where you can legally possess it. Then mail it back to FL when you are done.
The trust must meet the needs of FL, AC and the US of course. I am working on this for myself regarding full autos.
Now if the other guy on the trust dies then items is now all yours, but it cannot come into CA. I think, not sure, but I think you can store an automatic firearm at MG Kelly's in Nevada in a locker for an annual fee. I have not gotten around to checking that out yet."If Jesus had a gun he would be alive today"-Homer SimpsonComment

NFA is Federal. As long as the address where you intend to keep the item is a NFA friendly state, you'll be fine.
The only reason one would need identification from the state you intend to keep said NFA item in would be to convince the Sheriff to sign your Form, or to 4473 the item out of inventory when you're approved. The Feds themselves do not care. A trust voids the Sheriff-
