Mossberg 464 SPX tactical lever action cali legal?

Before I get burned lets just say I tried Googling and searching threads for this answer and couldnt find a definate Yes or No.

Im active duty military stationed in central california. Ive been looking for a lever action and really like the tactical 30-30 mossberg came out with. The problem I'm having is the only place i can find any for sale are on gunbroker.com and mossberg is way behind in production for these. Seems like all the guns for sale are on east coast and many vendors wont ship to california. Ive emailed a few vendors directly and the reasons Ive been told on why they wont ship to California range from "adjustable stock is illegal" to "not registered with californias DOJ". I spoke with a few gun stores around the local area and had no help. I got the "its your responsibility to ensure whether or not the gun you're purchasing is legal or not". Ive been trying to Google legal attributes and comparing them with the rifles specs. I downloaded the "California Gun Laws 2007" from the ag website and read the guidelines on rifles. Sorry but Ive only purchased one gun in california and it was a shotgun. If I order a gun off gunbroker and the vendor agrees to ship here but the gun is illegal Im screwed. The vendor said there will be no refunds or exchanges and I doubt Id be able to keep the rifle. I called mossberg directly and spoke with a rep. He said he believes the gun is illegal here also because of the adjustable stocks. But AR's have adjustable stocks here so Im confused. Then he said its because of the 5+1 ammo capacity which I thought California was a 10 round max?? Also I was told the mag capacity doesnt apply to lever actions??

The guns specs are- .30-.30, 16.25" barrel, 5+1 ammo capacity, and around
32" overall length with the stock in its shortest position.

I believe that in Cali the barrel has to be a minimum 16.25", 26" minimum overall length and no more than a 10 round mag cap.

Any help here? So basically i want a positive YES or a NO (with reason) on whether or not I can get this gun here...thanx

Yes it's legal. Here's the flowchart to help you identify legality of rifles: http://www.calguns.net/caawid/flowchart.pdf

There is nothing about that rifle that makes it illegal to own in California-- it is just a "dressed up" 5+1 lever-action.

It looks like Bud's Guns (check out their web site) has them in stock right now. They can point you towards a FFL dealer in your area that will receive the gun for you and process the transfer.

While that 464 SPX is definitely not ~my~ cup of tea... as others have said above-- if you like it, buy it!!!

Legal and it's different, and sometimes different is a good thing.

Also, if you do a little more reading here on Calguns, you will realize that out-of-state dealers on Gunbroker and similar sites spew a LOT of uninformed BS and FUD about California gun laws.

Great thanks a lot guys!! I had a strong feeling it was legal, just a little nerve racking when you have a bunch of vendors saying its not.

It's not illegal but it may just be a crime to own.

Just kidding if you like it by it!

There are vendors that won't sell bayonets and mag pouches to CA. Never, ever rely on a vendor for a determination of whether or not something is legal here.
