    Colt M-16

I know this has been addressed, but I am short on time and need an answer or be pointed in the direction of a quick answer.
I have a military buddy of mine that is in another state where cash and carry is legal. He found a SMOKING deal on an original Colt M-16 (in semi-auto). He lives and is stationed in CA (home of record). Can he buy it and bring it to CA?

    Thanks

I don't think he can legally buy it if he has a Ca residency and Drivers license

        Is it marked "Colt M16"?
He might be required to send it from the point of sale to a CA FFL.

However (if it's not on the original list) he should carry the upper half home and ship just the lower half.

AFAIK, there's no such thing as an "original" semi-auto-only Title-1 Colt M-16 (or at least one that's transferrable/civilian-ownable).

The only way this could remotely be the case would be if (1) it were an 80% receiver that someone finished and marked with the Colt and "M-16" markings, in which case it could hardly be called "original", or (2) was an actual Colt M-16 that someone removed the auto parts from, in which case it's contraban and not legally ownable due to the "once a machine-gun, always a machine-gun" position that the BATFE holds on such items.

If the price is too good to be true, then that explains a lot. I'd say stay far away from it.

He can't be a resident of California and buy a firearm in another state without going through an FFL in California.

I guess as a CA resident, he will have to pass on this deal.

M-16= full auto or select fire. To my knowledge you can't be a california resident and purchase in another state.

He should try to switch the selector to "full". If he can, it's probably stolen and he should remove himself from it's vicinity and notify the cops.

He can buy it there. All he needs to do is provide a copy of his orders that show where he's stationed. Those orders show that you he is now a resident of the state by way of military duty.
