Cali & pistol brace …. Is ok?

Laws rarely "allow" anything once you get outside of the constitution and the bill of rights.
What you are looking for is a law that actually makes braces illegal.Randall Rausch

From what people have written here and elsewhere who know gun law far better than I do, the safer way to own a braced pistol in Commifornia is to convert it to an AOW on an ATF E Form 1. I am in process on doing this and ATF is dragging their feet on my Form 1 (5 months to date) but if you have an AOW, that AOW is exempt from Commifornia's SBS abd SBR regs. As long as it doesn't violate the AW regs, which AR15 has typed out here before, it seems that legally, one is fairly safe. However we all know that a braced pistol or shotgun to a regular LEO who isn't versed in firearm law APPEARs to be an SBS or SBR. California has no legal designation for a pistol braces so as to whether a DA who wants to bury you construes that brace as a stock and tries to convince a judge and or jury that it IS an SBS or SBR and disregards that it is a registered AOW, its easy to see how one could be railroaded and made an example of, even though one did follow the letter for the law.
OP, we are behind enemy lines here so take that into account. If you shoot alone, in remote locations and are careful, you have much less of a chance of a LEO spotting your AOW and confiscating it and arresting you than if you show up at a public range and make a big deal about how you have an AOW. Are you getting what AR15 Barrels and I are telling you? Even though you can fully comply with the law, you can still get screwed big time. Do you have the time and money to hire some good lawyers? If so, they can likely get you off or plea bargain your case down to something minor but that could cost you hundreds of thousands of dollars in legal fees. Nobody here can tell you that you can proceed with impunity because this is Commifornia, the governments hates us and hates our guns and hates that we are even allowed, as their subjects, to own guns.
So in the end, IMHO, there is significant risk, even though you could be legal by possessing an AOW, that doesn't mean a gun hating DA couldn't completely screw you to the wall and send you to prison for it.Last edited by Capybara; 08-27-2025, 5:49 PM.NRA Certified Metallic Cartridge Reloading Instructor, Shotgun Instructor and Range Safety Officer

Unless one has significant amounts of resources to spend fighting in court, it is not a good idea especially if you reside in the blue sector of this State with a left leaning DA trying to make a name for him/herself.
BTW this tread should be in the handgun section. By you asking the question in the rifle section, will suggest your intent for the use.Comment
