Step "3" on the CA ID flowchart reads "Is the rifle an AR or AK type?" (I own a Saiga 7.62 x 39.) So I answered "YES" which moves you to #4, "Is the rifle listed on Appendix B or C?" Looking at "Appendix C, AK Series", I scroll down to "Kalashnikov USA; Hunter Rifle/Saiga". "YES" flows you to the next chart which reads "violates PC 12276(a)" which then flows to "ILLEGAL Unregistered assault weapon, .50 BMG rifle, or SBR".
This is where I am confused. I know my rifle is CA legal because I bought legally from a CA FFL, but I can see where this can confuse even a LEO when reading this flowchart. So I guess my question refers back to #3 on the chart, is my Saiga considered "an AK type"? If so, I can see how someone would consider it illegal if they don't know the facts or laws, which can be confusing in the first place. Any knowledge and feedback on this matter is much appreciated!
