Can somebody point me to the section of the penal code that explains registration of firearms? What I need is something that explains that lowers have a serial # and have to be registered while uppers do not have serials and do not have to be registered, or something along those lines. Thanks fellas.

There's not going to be a section telling you what you don't have to do. The PC is huge already, imagine if it also included what you don't have to do.
The section you want will probably just say that the firearm needs to be registered by serial number, they don't address that some firearms are sold in pieces.Comment

The rifle I'm talking about isn't an AW, it is an AR w/ a BB. However, long story short, I have a police report where the cop says she found a bunch of guns, all registered. She also says she found 2 guns that weren't registered, one is a lower, which is registered just like the rest of my guns, and an upper, which I am trying to find something to show this idiot that says it doesn't need to be registered because an upper is considered parts and doesn't have a serial #.
Sooo, in trying to find this I found something on the CA DOJ site that says CA has no registration requirement except for AW and handgun importers. So are all of my guns registered w/ the state or not? I always thought they were. What do the police look at when they find a gun and need to see who the owner is?Comment

Only pistols are actually registered with DOJ. CA DOJ doesn't keep records of long gun ownership.

So long guns are not registered at all? How do cops look to see who owns a long gun? Or is there no way? I know this lady isn't exactly Sherlock Holmes, but I would think she could at least get that part right.Comment

Yes, in CA. The guns were secondary to another issue that a family member caused which brought this lovely officer to my home. She isn't charging me w/ having an unregistered gun or anything, I'm just going through her reports and highlighting all the mistakes, inaccuracies and whatnot. I'm also trying to get documentation on everything. One of those mistakes/inaccuracies is her putting in the report that she found a lower that was unregistered (which it isn't, it was all purchased properly) and an upper that is unregistered. That is why I am looking to find something that shows that an upper doesn't need to be registered.Comment

Lowers MAY be voluntarily registered.
Only handguns must be registered (at the time of transfer).
California (currently) has no required registration for long guns, which would include a stripped lower.
If you have a handgun that you owned before 1991, it is most likely not registered, and it is not required to be registered. If/when you transfer it to another person, it will be registered to them.- Rich
