Would you be comfortable with a "6940" lower and a non-Colt upper?

Same lower receiver as the banned 6920 but without the "offending" upper, it *should* be OK. It might not be a 6940 due to switching the upper but it wouldn't be the dreaded '20, either.

That's my take. What's yours?

That would defeat the purpose of a colt lower. Only if I had the box that said 6940..

the second you swap that upper you actually put yourself at a higher risk of conviction. By taking a 6940 and putting on another upper you could be making a 6920.

The 6920 and 6940 have been reported to both have the same lower from the factory. A DA could argue you have made a 6920 by make and model.
