CA compliant AR-15 transfer from out of State

    CA compliant AR-15 transfer from out of State

    I tried to search but could not find exact answer to this:

    Is it OK for my brother in another state to buy a regular AR-15 (say S&W M&P-15), put a bullet button on it, throw away the high-cap magazine that came with it, and then transfer that gun to me? Of course he'll send it to a local FFL here.

    If it's OK, does he have to have his local FFL send it, or can he just send it on his own (to my FFL)?

    including the lower being off-list (which the S&W is good to go), then it is no different from any other long rifle.

    As a private individual, he can ship it directly to your FFL, as long as the laws of HIS state allow for that. BATF only requires one FFL to be involved, California requires that it be a California FFL, but the BATF also requires that the transfer follow the laws of both states.

      yes it is legal for him to do so, provide that ATF does not decide that he was acting as a dealer without a license, or say that he lied on the 4473 depending on how the deal went down.

      neither fedderal or CA law require it be shipped FROM an FFL, just that it be shipped TO an FFL. That other state may have additional laws, so can't comment on that. And your FFL may have a company policy to only accept shipments from other FFLs, so check first.
