    Bushmaster Transfer?

    Hello Everyone,

I have a friend that wants to trade me a Bushmaster AR-15 type rifle, which he said he purchased new about six years ago. I called a gun shop and they said it couldn't be transferred, even if I installed a bullet-button. Why would this be the case? Does anyone know a way around this? I really want that Bushy! Thanks!

If it says XM15 on the receiver, it's listed (banned).

      +1.

As a listed receiver, there is no way for you to now own it without getting a virtually unobtanium CADOJ AW permit.

Do you want an AOW or C&R SBS/SBR in CA?

It's going to be on the left side of the lower receiver, just like every other AR15 lower ever made.

            Sample (Not a Bushmaster):

Walk away. And your buddy should thank you for outing him on a felony (not that he didn't help it along...)

The only Bushmaster rifles legal in CA are those few marked "Carbon 15" (carbon fiber, not metal receivers) and which have a proper configured feaures suite (fixed mag w/Bullet Button or no evil features). I don't believe Carbon 15 Bushmasters were available 6 years ago.

And I doubt he purchased this new in California 6 years ago - he may have moved into California with it 6 yrs ago and not informed himself of the laws. No CA FFL would have sold him this rifle 6 years ago.

The rifle your buddy most likely has is banned by name ("Bushmaster XM15" is banned on the Kasler list of formally-identified AR series members; 11 CCR 5499). Rifles with these receivers have been banned since beginning of 2001.

Banned-by-name AWs cannot be converted to non-AW status. THERE IS NOTHING YOU OR HE CAN DO.

To stop legal problems your friend should IMMEDIATELY:
                - strip parts down to bare lower receiver;
                - separate parts well away from receiver (different location?)
                - contact an attorney to arrange surrender of the receiver to LE

This helps stop the ongoing crime, but does not erase prior crime.

UNDER NO CIRCUMSTANCES SHOULD HE TRY TO TRANSPORT OR MOVE THE GUN/RECEIVER OUT OF CA. That can add risk of felony transport of unreg'd AW on top of 'wobbler' (felony/misdemeanor/civic nuisance) of simple possession - he risks jumping out of the frying pan into the fire.

Other "solutions" like destroying the lower receiver do not stop the prior crime even though ongoing crime has ceased; an attorney can transactionally 'clean up' situation thru surrender.

This post/thread is a perfect example yet again why situations should be posited here hypothetically instead of in an incriminating fashion. (i.e, "What if somehad a Bushmaser XM15? Could I buy it? Would a dealer handle it?")
