if he owns rifle lowers and has obviously not DROSed a pistol yet he falls into Constructive possession land...

He could have the upper sent to the dealer with the pistol lower to avoid it.

Ok, just got a bit confused, I thought he already owned a pistol lower.

questioned though, if lower pistol is on a 10 day waiting period and ordered an upper let's say 10.5. is this still considered CP???

well technically if it were a lower only I'm guessing he would then be PPTing it....

the following is just my opinion

I would take caution in possessing a short upper and a rifle lower without signing out my pistol lower from my dealer first....

It would not belong to me until then...if I were arrested before I picked it up, I would technically not own one yet to prove myself innocent

But that is just me. What if for some reason he was denied or a hold was placed? (happened to me for a speeding ticket)

I was speaking in general to those reading the thread thinking... gee there is a 11.5 on GB for $500 shipped, I could just keep it as a spare for SHTF day.

you'r prolly ok with the upper if you are in the prosess of transfering a pistol lower, I might ask the FFL to hold the upper for the rest of the 10 days to be on the safe side

In case it wasn't clear, what I think Bill is saying is that if people are NRFing on a widespread basis then the court might throw out on the theory that the plaintiffs have an avenue to getting their guns already. Then we are still stuck with the roster and a workaround that will still distort the market for all those not willing to go to the extra trouble and, more importantly, no caselaw saying that such things are Unconstitutional in the first place.

I hope it's obvious that tossing the roster completely and establishing some caselaw affirming real teeth to the 2A are both separately more important than having a workaround (which, in any case, would still exist as some kind of plan B if were to fail).

Hey quick question... If I own an AR pistol can I also own a couple of other complete pistol Uppers for it as well??? Or will I be crossing the boundaries because I also own a complete AR rifle?? Not sure if the question came out right but....anyone?
