    Featureless legality out of state transfer

    I recently ordered a CENTURY 308 rifle from an out of state dealer.

    They agreed to ship the rifle with the pistol grip detached and no flash suppressor. I was planning on putting a grip wrap on it.

    When It arrived at my local FFL, my FFL called me and told me the rifle is sent broken down with the receiver and top detached.

    He told me they won't be able to legally transfer it to me unless they ship it back to them and they only ship them the receiver (serialized part) and the rest to me.

    Now when I contacted the out of state dealer, they refused to ship them separate and told me I can only get a refund minus 15% restocking fee.

    I just didn't want to take my FFL's word for it, so I am asking for any input on this situation. Thanks.

    should have checked with your receiving FFL first as every FFL has different interpretations on what is legal or not regarding configuration. Although it's technically legal how the rifle got sent in, it's their store and their rules.

      I've got an interesting interpretation. Rifle must enter Cali Cali compliant That means with the fun grip on and maybe a barrel nut. Another FFL interpretation but works for me

        Always ask receiving FFL how they will accept a firearm first, from out of state.
        It does not matter what " we the people say ". Its his store.

        Your stuck. This is why a lot of out of state gun stores won't do business with cali.
        Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.
        I really miss the good old Pomona Gun Shows.

            I wish I checked with my local FFL first, lesson learned.

            When I placed the order on their website they had my FFL listed in their system so I assumed they dealt with them already. If I return the rifle I will lose my 15% plus shipping.

              Could they let you have the upper and the DROS the lower after you take the upper home?

                If they ship the upper detached from the lower it isn't a center fire rifle.

                    Its safer to order those kind of rifles from Atlantic firearms.
                    Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

                      He doesn't have to. It's a receiver with some parts on it, period.

                      OP, if you want to do two transactions, DROS and buy the lower now and have the shop send the upper back. Contact the vendor and have them ship the upper to you, not the gun shop.

                        My FFL is close to crapping himself, he said an ATF agent told him that the rifle should not even be in California period in that configuration lol. He said the only option is to send it back. Great.

                          Maybe I am misinformed but I dont see how that makes any sense...

                          You can go buy completed lower receivers for an AR15, with a pistol grip and collapsible stock, and thats just fine within the law.

                          It only need to be compliant when paired with an upper receiver.

                          So if I am interpreting your post correctly the dealer sent your FFL the rifle, without a flash hider, and without a pistol grip AND the rifle was taken down to some degree. But even if it was completely assembled, the FFL would receive a complete rifle, sans pistol grip and flash hider. Isnt that the equivalent of getting say an M1A or a Mini 14?

                          Seems to me like your FFL THINKS that what happened was illegal and either fed bad info to an ATF guy or, and this could be the more likely scenario, lied about talking to the ATF to scare you out of the deal and get, what he thinks is a felony in a box, the hell out of his shop.

                          Unless the dealer screwed up and sent the flash hider and pistol grip in the box (HAving all the parts shipped together could be intent to construct as an assault weapon perhaps?) or I am misinterpreting something I dont see what other explanations there are.
