    Intra-Familial Transfer

    I've searched, but only came up with out of state transfers. I want to transfer some of my rifles and handguns to my father before any "ban" may be imposed upon us. He already has his own AR and handgun, but I have some firearms that he loves and that I don't want anymore.

    Can someone direct me on how to this? If this is in the wrong forum, my apologies.

    If you both are CA residents, and he has a firearms safety card or exemption like CCW, Hunting License, retired military etc - you can hand him the guns and he mails in this form with $19:

      does my father have to go thru an FFL at all? He is also a CA resident.

        No he does not. Son can give guns to father without using a FFL if they are both CA residents. He just needs a FSC or exemption and he needs to mail in the form and $19. The forms can also be submitted online now.

        The California Firearms Application Reporting System (CFARS) is a web-based application that will allow an individual to report their firearms to the Department of Justice (DOJ) using California Reporting Information System (CRIS) reporting forms, as outlined in California firearms laws and regulations. For your protection, the DOJ does not process credit card payments nor does it retain record of the credit card data. All payments are conducted through a third party payment application processing company using secured transactions.


        Report of Intra-Familial Firearm Transaction
        Pursuant to Penal Code sections 16720 and 27875, a person that is at least 18 years of age and who has a valid Firearm Safety Certificate (FSC) may take title or possession of a firearm by gift, bequest, intestate succession or by other means from an immediate family member, in-lieu of completing the transfer through a licensed firearms dealer provided that the transfer is infrequent and that the Report of Intra-Familial Firearm Transaction is submitted within thirty (30) days of the transfer.

        Use the Report of Intra-Familial Firearm Transaction if:
        • You are at least 18 years of age or older
        • You have either a California identification, driver license or military identification
        • You have a California residential (street) address
        • You are not prohibited from owning/possessing firearms
        • The firearm being reported was acquired in-state as a gift from an immediate family member (as defined by Penal Code section 16720)
        • You currently possess a valid FSC, or in the case of a handgun, a valid unexpired Handgun Safety Certificate (HSC), or a FSC exemption, pursuant to Penal Code section 31700
        • The firearm is not an assault weapon as defined in Penal Code sections 30210 through 30530

        As used in this part, “immediate family member” means either of the following relationships:
        (a) Parent and child.
        (b) Grandparent and grandchild.

        (a) Section 27545 does not apply to the transfer of a firearm by gift, bequest, intestate succession, or other means from one individual to another, if all of the following requirements are met:
        (1) The transfer is infrequent, as defined in Section 16730.
        (2) The transfer is between members of the same immediate family.
        (3) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall submit a report to the Department of Justice, in a manner prescribed by the department, that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The reports that individuals complete pursuant to this subdivision shall be made available to them in a format prescribed by the department.
        (4) Until January 1, 2015, the person taking title to the firearm shall first obtain a valid handgun safety certificate if the firearm is a handgun, and commencing January 1, 2015, a valid firearm safety certificate for any firearm, except that in the case of a handgun, a valid unexpired handgun safety certificate may be used.
        (5) The person receiving the firearm is 18 years of age or older.
