Yup, it is still considered a rifle. If you go below 16" barrel / 26" OAL, you have created an SBR per FED and CA law. Plus, you may run afoul of the 30" OAL regs on semi-auto rifles.
Those AR pistols you see were built on virgin receivers that had never had a stock attached to them. They were never built into a rifle, so SBR rules don't apply to them.Comment

I beleive the pad is more for your face than for your shoulder. although there is nothing stopping you from putting it on your shoulder.

The foam on AR pistol buffer tubes only wraps around the edges - not the rear most facing face of the extension tube. They are padding/protection for your face or side, depending on where you are shooting it from. It could also be argued that it's to damped the spoing noise of the buffer.
If you put ANYTHING on the rear face, outside of a sling swivel, and that includes a strip of foam, you have now put a stock on it and it becomes an SBR. That's why the foam is always sold in sleeve form, not in sock form. If you look into how the ps90 internals work, the stock is part of the operational mechinism of the rifle, same as the ar pistol. It is possible to have a ps90 pistol, just write FN and ask them to manufacture it and stamped as pistol. problem solved.Comment
