    80% ar pistol build

    Hello, newbie to the site but have lurked for years.
    This may have been covered but...
    I am in California (since 68) and wanted to build an AR pistol from 80% lower, with bullet button. Is this possible without any LEO problems?
    As this is now a "non removeable" (without tools) magazine, can I have a more than 10 rd mag installed (previously owned)?
    I do have a registered AR rifle. Will this AR sitting along side the shorter BBL pistol model create any problems?
    Would prefer responses from those who have real world experiences with these issues. Thanks in advance.

        With the SSE gone. Id be careful about building ar pistol. There's no way to single shot exempt them after your build. But you can always single action exempt it.

          Well if OP builds the 80 "out of state" SSE doesn't apply.


          Just do your 80 "out of state" OP.

              transport into or receive in the State where he resides (or if the person is a corporation or other business entity, the State where it maintains a place of business) any firearm purchased or otherwise obtained by such person outside that State

                My phone randomly puts "out of state" in quotations. Must be a apple virus. I really meant build it "out of state"

Because i thought you could buy/bring in any non roster gun as long as your already own it out of the state or purchase via PPT. SSE is only subject to "new firearms". No?

                  It depends what you mean when you say "SSE".

                  If you are moving into CA you can import off-roster handguns so long as they are not imported with the intent to sell them.

                    SSE is not gone. It just changed a little bit on January 1st.

                    That said, I'd still be very careful about doing an 80% pistol build. There is no way to complete an 80% pistol build without taking some legal risk.

                    Please review California's "Zip Gun" statute, and the "Safe Handgun" statute (along with the current provisions for SSE exemptions). Once you fully understand both laws, then you'll be in a better position to judge those risks for yourself.

                      So what if I live or even don't live in let's say AZ, but are there and buy a gun (I know they won't sell because you need a DL but just to ask) or build a 80% say at a friends house and come back to CA?

                      You can't import the 80% pistol for your own personal use? I thought the whole issue stopping pistols was SSE in this state. What if it was made out of state and brought into the state? Resident or non?

                      Not trying to argue and all hypothetical but seriously curious on how that effects bringing in a 80% as a CA resident.

                        If you buy, or build, a firearm in Arizona without being a resident of Arizona, and bring it back into California, then you've committed a federal felony (with a five year penalty). Please refer back to post #7.

                        If you build that weapon while a resident of Arizona, and then bring it into California, then you'll need to register it as a "Personal Firearm Importer." Please refer to Penal Code section 27560.

                        If you build that weapon while a dual resident of California and Arizona, then you'll need to deliver that weapon to an FFL and have FFL document the importation to California. There is some current debate on this forum whether the roster would apply. Please refer to Penal Code section 27585.

                            SSE is not gone. It was just changed to say the gun must start life as bolt action pistol, instead of merely a "single shot". So if he built the pistol without a gas system and made it work as a straight pull bolt action, wouldn't that be legal?

                              That would probably comply with the SSE exception to the "Safe Handgun" law. I qualify with the word "probably" because we really don't know how 58 different District Attorneys are going to interpret "Bolt Action".

                              The other thing you have to consider is the "Zip Gun" law. That one is a nightmare because of the way it incorporates the federal excise tax into its elements. In the worst case, if the tax element goes against you, then your weapon has to be built to the design of a licensed manufacturer to not be a Zip Gun. If you build the weapon without a gas system to be a straight pull bolt action, what design of a licensed manufacturer would you be building to?
