How do I get my money back from Mayfield/Gilman/Gilmay?

    How do I get my money back from Mayfield/Gilman/Gilmay?

    (Sorry if this is in the wrong section, but I wasn't sure where to put it, so mods please move it where you see fit; thanks.)

    A buddy of mine put down a big deposit on a Springfield 1911, back in February of 2012, at Mayfield or Gilman or Gilmay Guns (Fresno, CA). He was told to wait, didn't hear anything from them, and then they closed down. My buddy has been calling them, and leaving messages, but no response.

    Does someone here know how he can contact them? Or what he can do to get his money back? Any help is appreciated. Thanks.

    Obviously, he needs to get in contact with the owner.

    Your local BATFE office can probably assist in finding him.

      Contact DOJ or BATFE to see who had the license then sue in small claims.

          I'm sorry to be the bearer of bad news but trying to go after an amount owed (deposit) back after more than 2 years - on an unsecured nature - your friend I do believe is out of luck.

          A receivable/payable is generally considered stale after 180 days, and can't stay on the books indefinitely. I'm no accountant but you can't keep deposits on the book for extended periods of time - like 2 years.

          Don't know a darn thing about Gilmay (or Mayfield or Gilman) Guns. But what I can say is there is typically a pecking order of who gets paid first in a BK or workout situation.

          Secured creditors (those who have legal ownership - filings on company assets purchased via normal banking lines - UCC filings).

          Unsecured creditors - vendors and such - banks - on unsecured lines, vendors & other mainline suppliers as well as bondholders

          Lastly - the owners - the stockholders. If there is anything left (rarely) the owners of the firm get paid last.

          It *sounds* like if they have closed shop and aren't returning calls (is there still a message on the Voice Mail indicating company?) - you are screwed.

            My buddy made the deposit, and was told it would be a few months. He kept in contact with them, and was told to wait some more, up until they were closed, and then he couldn't get a hold of them. He's been trying ever since.

            Thanks iluvmycolt, I'll forward the info to my buddy. If that fails, he'll probably have to contact BAFTE, DOJ, local police or a lawyer.

              Look like they closed up shop end of October 2013. I'd say your buds likelyhood of getting the deposit back is nil.

                    He's pretty much screwed and can kiss that money goodbye. Even if he were to granted a judgment in court have fun trying to collect on it.

                      Check the State unclaimed money account under the name he used when he put the deposit. Its a longshot but....
