FFL <--> FFL procedure w/in CA?

    FFL <--> FFL procedure w/in CA?

    My local FFL takes the position that the other guy has to go first. I.e, *after* my FFL receives the other one's info, *then* he'll send his and get on with the transaction. Recently, on a transfer coming in from out of state, this led to a pissing contest, with neither FFL wanting to go first. The other guy relented, thank God.

    So now I'm working on a transfer from SoCal up here to NorCal. The SoCal FFL says the (new?) CA procedure requires the receiving FFL to go first. True?

    I really don't want to have this discussion with him again, but if I had some law or regs or something to back me up, I'm sure he'd do it.

    Just an inclination on my part, but I'd say the FFL receiving the gun goes first re sending FFL copy info. They are working on behalf of the person initiating the transaction, correct? Sending the (receiver's) FFL shows the sender the transaction can be completed, demonstrates good faith. Furthermore, the person sending the firearm is not legally required to send it from an FFL and the transaction can be completed without an FFL sender, but the person receiving must go through an FFL. When I buy a C & R with my Type 03 FFL I have no hesitation sending my FFL first, so I vote receiver goes 1st or "no gun for you - NEXT!"

    So far as the law (Type 01 to Type 01) goes, the FFL sending must verify through CFLC that the Type 01 FFL is eligible to receive, so the receiving Type 01 FFL has to provide his FFL to verify and ship. But as to going first? I really don't think there's anything in law regarding first, only before the gun is shipped.

    BTW, does your FFL take the approach that the other guy always goes first? If the "other guy" goes first because he's buying, what does your FFL do when he's buying, or vice versa?

      ^^ Good point. I don't know his position when he's the shipper. His position as the reciever is that he's "doing the other guy (the seller) a favor" (yes, actual quote) and so shouldn't have to go first.

      A nearby (30 miles) FFL will not play these games, so I imagine I'm off to him.

        What nonsense! Your local FFL should be happy to have your business and send of a copy regardless of who is first. I am unaware of any law pertaining to this simple procedure.

          As the receiver supplying an FFL is the law of course, I'm guessing this FFL charges for the favor, right? An appropriate move on your part going elsewhere I think - sounds rather childish.

            Receiver goes first. Shipper verifies using the new verification mode online that the receiver is actually a DOJ approved CA FFL and then ships.

              add to the end of that:...and includes a copy of sender's FFL and Letter of Approval with shipment.
