    So... anyone open carrying?

    Has anyone done any individual open carrying since the OC lunch or anything? Just curious to see the impact on individual behavior... or something.

    First off, as most of you know, I have strongly defended open carry in the past, and I will be the first to say that it IS your right and that by current STATE law it is probably legal if done correctly. At this junction however, I am asking everyone NOT to open carry. The reason is the Right People and the Calguns Foundation are not in a good position to take on any additional OC cases. Furthermore, additional OC action NOW, before we get incorporation is simply counter productive and will likely make the job of the NRA and Right People more difficult.

    Not only will you not be helping the Cause, but there is a very good chance if you open carry that you will be arrested. If this happens you are looking at spending a MINIMUM of $10k out of YOUR pocket to avoid a conviction. Even then you won't really be proving anything. Realistically, unless you have about $50k to spare then you are not in a position to OC at this point. There are also city ordinances that may not be preempted by state law which could result in a lawful conviction for open carry that would otherwise be legal by state law.

    Even if you are arrested and charged for legal open carry, and all charges are later dismissed against you, it is highly unlikely that you will ever be able to get any significant damages from the government agency responsible.

    Once we get Heller incorporated we can work on getting shall issue CCW or loaded open carry, but now is not the time. So just don't do it. Yet.

      Wasn't aware of that post. Escondido is pretty easy now since the local cops know it to be legal. I will keep my eyes on further developments though.

        What does it matter what Blackwater has asked? The open carry people will do as they have done. Not because someone has asked them not to...Heck, there will be open carry people that will get busted for whatever reason, and they couldn't tell you who or what a Blackwater is. I just hope if they do (open carry) they can afford the defense.

          It matters because it's more than just BWO "asking" for UOCers to chill. Read the thread and you'll see plenty of good reasons..namely the ability to gain CCW shall issue as a right in this state..or at least a good shot at it.

          ALso, the opencarry site likewise has suggested this.

            There were a lot of really bad arguments against Open Carrying in that thread, and a couple good ones.

            One that really made sense to me was Gene, who stated that we want to avoid having SB 1171 changed in "emergency legislation" into a sweeping new defenition of loaded that would kill both UOC and transporting ammo in the same case as a firearm. After 8/31, the legislative session will be over and that risk will be over (for this year anyway).

            Edit to add: Another compelling argument made was the fact that once Heller is incorporated, it will make it possible to sue arresting officers for a civil rights violation.

                My sense was that as a community here, we would try to encourage fellow members in directions that could benefit the entire same community.
                I felt Blackwater made a pretty compelling argument for possibly not oc'ing.

                Just doin my small part here to encourage what I felt was a sensable request.

                It wasnt an order, nor a rule, it was a request to be careful with it.

                I didnt tell anyone not to do it.

                    I have OC'd in an effort to bring about CCW, if chilling for a while will do more good for my cause, then I will gladly refrain!!!

                        More than likely that one guy would have no clue about the bigger picture or of what was asked.

                          All that has been asked on this forum in regards to the abstainment of oc seems tp make sense and for that I will stand down on my activities until further notice. What is the approximate time that I can resume my open carrying activities? I believe I saw mention of 8-31 as a date of resuming normal activities so please correct me if I'm wrong.

                            That is when the law making stuff ends till '09. If we make it past 8-31 we are safe from that law from occuring.

                              It sucks though, the shopping center where I work at has had 2 banks robbed and the Jamba Juice just got nailed the other night as well at 8pm! Now I hate going into that area without my heat...
