C and R Handguns

    C and R Handguns

    I am a new FFL/CL dealer. I have a client who collects C and R 1911 handguns. Is he limited to 1 a month as with modern handguns? I thought I read a paragraph somewhere in this pile of DOJ stuff that C and R eligible guns were exempt.

    If he has the COE (Certificate of Exemption) that wait time (1 in 30 days) does not apply to him.
    Only the 10 day wait time (DROS) per handgun applies.

      I currently hold a 03 FFL (C&R license) and a COE (Certificate of Eligibility). I am exempt from the one handgun (modern or C&R) every 30 days, and if purchasing a C&R handgun, I am exempt from the 10-day waiting period. If your client has a 03 FFL but not a COE, the 1 handgun per 30 days applies. DROS still apply to all cases.

          What about the California 03 FFL holder who acquires one or more C&R firearms while out of state? Don't believe waiting periods, DROS, or number of C&R firearms acquired in a 30 day period apply in this scenario. Think the only requirement is that this form be filed.....

            Agree, that's why I said DROS still apply to all cases. I should've clarified more in that when I said "DROS", I meant only the registration part, since if he has both 03+COE when purchasing a C&R handgun, he does not have to wait the 10 days that is also part of the normal DROS/background check process.

              A person with a valid C&R Type 03-FFL and valid COE are exempt from the 10 day waiting period when acquiring C&R firearms from a CA FFL dealer. [PC 26970(a)]
              This exemption only applies to C&R firearms [PC 26970(a)(1)] and does not apply to non-C&R firearms.

              A person with a valid C&R Type 03-FFL and valid COE are exempt from the 1 in 30 day wait for handguns. [PC 27535(b)(9)]
              This applies to all handguns, not just C&R handguns.

              A person with a valid C&R Type 03-FFL and valid COE are exempt from the HSC requirement when acquiring a C&R handgun. [PC 31700(a)(6)]
              This exemption only applies to C&R handguns.

              A person with a valid C&R Type 03-FFL can legally acquire a C&R firearm outside of CA and bring it back to CA. [PC 27565]
              In addition, within 5 days of returning to CA with a C&R handgun(s), the handgun(s) need to be reported to CA DOJ BOF [PC 27565(b)] and starting 01-01-2014, the reporting requirement applies to all C&R firearms. [PC 27565(a)(3)]

              Starting on 01-01-2014, a person with a valid Type 03-FFL and valid COE are the only people exempt from needing to use a CA FFL dealer to transfer a C&R long gun. [PC 27966] This exemption only applies to C&R long guns [PC 27966(b)&(c)] and the person acquiring the C&R long gun must report the transfer to CA DOJ BOF within 30 days of acquiring the C&R long gun [PC 27966(f)].

              C&R handguns are exempt from CA's "unsafe handgun" laws and are not required to be on the CA DOJ Roster of Handguns Certified for Sale. [PC 32000(a) & PC 32110(g)]
