    G21 from LEO

Howdy all, a California firearm legal question for you ...

Admin where I work, her husband is a LEO and his dept. is getting custom S&W semiauto's, and he wants to sell a Glock G21 he was using. However, it has 13 round magazines.

My question is, is it technically legal for him to sell me (civilian), magazines >10 rounds.

I ask this because I really wanted a Ruger LPC, but the only way to get one in this state is ex-LEO owned. Now, that scenario is okay, are post-ban mags >10 rounds okay to sell private party?

    Thanks,

No, it is never OK to receive magazines with a greater capacity than ten.
If it was a snake, it would have bit me.

It would be illegal for him to to sell you magazines greater than 10 rounds.

Never? I have a Hi-Power with several 13 rd. mags (& a 30 just because I could at the time). If I ever sell it, I can't sell the mags because they are greater than 10 rounds?

Correct. You can sell the pistol, but not the magazines.

this all assumes the magazine purchaser is in CA of course.

I have a buddy in his situation, has pre-ban mags that came with a pistol in CA. He's allowed to sell it out of state? Does he just deliver it to a CA FFL like a normal out of state sale?
