if i "find on the floor" 5 17 round ruger sr9 mags, i can legally own them and use them right ?

It's weird how many people seem to lose mags and what's even stranger is how many People find mags on the ground. I've found plenty! People should be more careful...

I don't want to threadjack, but I have a question of my own. What if you order a 10-round mag from eBay but the seller sends you a 15-rounder by mistake?

I've seen worse legal advice in threads but I cannot remember when. No, there is no legal way for an ordinary citizen (i.e. not one of the ruling class like Diane Feinstein) to own 17 round mags in a Ruger SR series pistol in California and you are looking at a penal code violation if you do. Good luck convincing a Judge that they magically appeared. Not going to happen.

Given that possession of a standard capacity magazine is not a crime. It is entirely possible that a regular citizen may find magazines such as these abandoned or lost by law enforcement or citizen that illegally acquired them and do not want to get busted.

I know of a few people that have come across magazines from weapons such as the mp5, ar15, glock, xd, m&p, p2000 and many more at indoor and outdoor ranges.

Even one guy who found an entire box of CBP duty gear.

So if someone ordered standard capacity mags and accidentally sent them to my house and there was no return address I could legally keep them?

Yes it is legal. The burden of proof is on the state. They have to prove that you bought/transferred/assembled the mags which are illegal ways to acquire them. Finding them is not mentioned as an illegal way to acquire a mag therefor its technically legal. I personally have found AR, AK, glock mags left at ranges before, it does happen. Yes you can find mags for pistols that were not even in production in 1999.

"Penal Code 32310 (Was 12020 (a)(2)) states:

Except as provided in Article 2 (commencing with Section
32400) of this chapter and in Chapter 1 (commencing with Section
17700) of Division 2 of Title 2, commencing January 1, 2000, any
person in this state who manufactures or causes to be manufactured,
imports into the state,
keeps for sale, or offers or exposes for sale, or
who gives, or lends, any large-capacity magazine is
punishable by imprisonment in a county jail not exceeding one year or
in the state prison."

As it has been said before, burden of proof is on the state. Possession of a large capacity magazine is not illegal.
