    gifted gun help

    Greetings all,

My mom who lives in Washington state, was just visiting and handed me two revolvers as wedding gifts to my wife and I.

Now if she lived in CA, we would be good to go, both go to me, I give one to the wifey, and fill out the familial transfer form.

Since she is out of state, it has to go through an FFL correct? She also can not give a firearm directly to my wife correct? Now if this goes through an FFL I can only do one pistol every 30 days.

So do I ppt one a month, then do the inter-familial transfer to my wife? Any suggestions on how this should happen and a recommendation on a FFL to do the paper work in the Santa Cruz (I could go to San Jose or watsonville) area would be great.

    Thanks

Does not qualify as a PPT as for a PPT both the transferer and the transferee have to be CA residents. Basically it is the same as any other out of state transfer without having to worry about the roster. Because it is not a PPT the FFL can charge as much or as little as they want.

Assuming she is still here you can go to the FFL with her and do the transfer (one per 30 days but they should be able to hold the other one until you can get it). If she already left then you are both felons if she left the guns here with you. If she took them back with her then she can send them via approved method to the FFL of your choice with a simple note saying that she is your mother and wants to gift you these guns and that no money has exchanged hands.

Since this type of transfer is uncommon some FFL's are uneducated about them and will tell you it is illegal. Best to call around before shipping them or driving down there to find out they wont do the transfer and to check the price.

If the revolvers are on-Roster, or exempt, Mom can interstate-transfer one to each of husband (son) and wife. Each needs an HSC to receive the gun.

If the revolvers are off-Roster, then both to son, but 1-in-30 applies.

Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!
