    Interstate transfer within the family

    My younger brother lives in Texas and has a Ruger SR1911 that I would like to purchase. He is a Texas resident and I am a California resident.

    My question is:
    Can he fly to California with the gun (declare it in his check in bag) and do a FTF transfer to me, once he gets here? By the way the gun is not on the California roster list.

    Any information would be helpful. Thanks.

    No.

    Must go through CA FFL, and not a PPT but an interstate transfer.

      We can go through a FFL. Can he hand carry the gun to the FFL or does it have to be shipped from Texas?

        Your ffl would also have to be willing to SSE it since its off roster. Call your ffl first they all have their own rules about how they are willing to receive the gun

        Or your brother could transfer it to one of your parents and then transfer it to you. Again ask your ffl as they don't all understand this.

          Intrafamilial, even interstate, is exempt from the Roster.

          Call the FFL where you plan to do the transfer, and see what their business practice is; no legal requirement to ship from an FFL.

          ETA except I am reminded that this is brother to brother - and that doesn't work for intrafamilial (CA accepts children/parents/grandparents only).
