SA XD40 legality question

Gents,

I'm looking to purchase an XD40 V-10 ported model but I can't determine whether or not it is legal to import it into the State.

I contacted Springfield and they said the "XD9702SP06" model (with the 10 rounds) IS legal. But I then contacted my FFL and he said that the model number must match EXACTLY to the CA approved list, which simply reads: XD9702.

So, my question: does anybody know if the XD9702 is the same thing (or an abbreviated version) of the XD9702SP06? "Both" are 4" .40 cal v-10 ported black on black 10 round handguns. Even Springfield doesn't seem to know...but I personally think that they are one in the same and that the CA list allows ALL XD9702 models, as long as they come with the 10 round mag.

I've been into multiple shops over the last few weeks, and different people at the shops have had all types of answers, from "we can get it" to "sorry, we can't import that". Quite frankly, I don't think anybody really knows.

Am I overthinking this? What happens if you accidentally order a non-importable gun? (I'm assuming the FFL just ships it back and you pay the shipping?). Any help would be appreciated.

It's perfectly legal to "Import" a Springfield XD40 into the state regardless of the "Safe Handgun Roster" so long as it hasn't been modified into an illegal configuration (such as a threaded barrel). It is illegal to import a large-capacity magazine into the state, either as part of the weapon or separately, unless you have an exemption.

It is illegal for an FFL to transfer an off-roster handgun to an ordinary purchaser (There are exceptions for LEOs).

The distinction is important. If you already own the XD40, you can import it into the state so long as you don't also bring in a large-capacity magazine.

Your FFL can also import the XD40. He can transfer it to an LEO, or he can sell it out of state. He just can't transfer it to a regular purchaser.

There may be options to purchase it if converted to a single-shot. I'll defer on that point to others more knowledgeable than I on SSE's.

The XD40 in question I'd like to purchase comes with 2 12 round mags, but I'm going to ask the gentleman to simply leave those out of the deal and/or replace them with 10s. Outside of that I wasn't sure if the model number of "XD9702" vs "XD9702SP06" or "XD9702HCSP" made a difference getting the gun through CA "customs", if you will. I'm just trying to do it all by the books.

The "off roster" distinction is the key here. What IS allowed via the CA DOJ is a "XD9702". What I would be purchasing would be a "XD9702HCSP" and what Springfield Arms told me was perfectly legal was a "XD9702SP06". The similarities between the model numbers are clear, but obviously they are not the same.

Both (I say both because I'm not sure "XD9702" even exists) are EXACTLY the same gun, save the magazine. The semantics are making my head spin.

This is they key: does anybody know if the model number (for example: "XD9702HCSP") needs to be EXACTLY what is listed on the CA approved list? One FFL I asked says yes, Springfield Arms says no.

What happens if I accidentally order an off list gun? They just ship it back?

I was trying to highlight the difference between "Import" and "Transfer." It's a semantic that does confuse a lot of folks.

As to the model designation. I simple do no know the answer and don't want to mislead. The person who's judgment will be most critical on the question is the FFL who will be processing your transfer.

Most FFL's sell from their inventory and have the responsibility for managing that inventory. If you're contemplating purchasing the weapon and then having it shipped to a California FFL for release to you, the worst outcome is that you may become the owner of a firearm that you cannot take possession of. Most dealers have contract terms that allow them to take ownership of a weapon for storage charges after a period of time.

I'm just trying to make sure everything is correct before I place that bid down! Seems to be a lot of work to just get one measly ported .40.

i dont know if this will help answer your question but there is a local FFL near me that has a 4" V-10 in black sitting on the shelf. the FFL i mentioned is near santa cruz california if your willing to make the drive but i would call first.

High Capacity
Package (holster, mag. pouch, speed loader) started about year 2006, this part can be ignored.

Rostered version is with out HC (there will be a sticker on the box, so maybe a no go on the magazine swap, not sure).
