    Sig SP2022 CA legality question

    Hey all,

    Handgun noob here and I have a quick question. I'm interested in an SP2022 and am a bit confused on magazine sizes. I understand that CA law mandates a 10 round magazine. However, it appears SP2022's come in a 12 round magazine and 10 round magazine variety. Is the 12 round variety CA legal as long as a throw a 10 round magazine on it, or is something physically different about the firearm that makes it illegal?

    OK, so the handgun itself is CA legal no matter what the quoted "magazine size" is? I'll just need to purchase a 10 round magazine. Is that correct?

      Are you asking about the ability of the pistol to accept either the 10 or 12 round magazine?

        Well, I am interested in the answer to that question, yes.

        But I am mainly interested if this particular Sig is CA legal if I purchase a 10 round magazine.

          If you are not LEO, the selling or delivering dealer cannot deliver it to you with the twelve round magazine. They probably will be reluctant to swap out the magazine at time of delivery to you unless they have an established good market to sell the twelve rounder. I don’t know where you live. Turners in Southern California has these on sale periodically a lot cheaper. Right now it is hard to find much of anything you are looking for due to the panic buying. Just got to be patient and keep looking. Keep in mind. There are two different variants of the SP2022 in 40 S&W. Try to get the model that doesn’t have the loaded chamber indicator on the top of the slide. The one that doesn’t have the loaded chamber indicator can also shoot the 357SIG with only a factory drop in barrel change. This is the cartridge of my choice. It is just expense to shoot.           PS: magazines are not cheap. Wait until you find it with the ten round magazine.

            I have a similar ? The dealer agreed to ship a handgun to the FFL (15 Rd mags included) As long as the FFL was willing to accept.
            The FFL agreed.
            Am I to assume the FFL will remove the mags and I will be mag-less? Really hope that I at least am able to get a 10 rd mag out of this transaction.

            especially since mags are impossible to buy

              Ok I think I understand your question(s) now:

              There's no difference betwen an SP2022 that comes with a 10 round mag vs an SP2022 that comes with a 10+ round mag. It's the same gun, just the magazines are different.

              Personally, I'd look for one that was already in CA since that would be simpler. The price on the website you show is not a great price, especially since you are not going to get the magazine with the gun.

              One thing you did not mention in your post, but which does have an effect on whether a gun is available in CA, is the Roster of Handguns Certified for Sale. You can find the Roster here:

                Yep. The gun is legal. Mags of over 10 rounds aren't. So, you get the 10 round mags and you're good to go. That's the simple answer.

                It can be more complicated if you want. California has a "safe gun roster" which the 2022 is on, so its legal. But guns have to be renewed on it, so it could fall off. also, some people say the 2022 10 round .40 mags can hold something like 12 rounds of 9 and work. There have been debates on the legality of that. To be safest, don't, and besides it may not be fully reliable.

                Another wrinkle is that if you buy a 2022 and it comes with a 12 round mag, well, under my reading of the law you're still good. You didn't make or import an illegal mag; buying or possessing one is not prohibited. Making or importing is.

                So, in sum, the gun's fine, and get the 10 round mags. The California laws on this are well known so there are 10 round mags out there.

                  But, buying is not an exempt method of acquiring a large capacity magazine, so any large capacity magazine you buy are subject to confiscation by LEOs. [PC 32390]

                  Therefore, it's not illegal to buy them, but you won't be able to legally keep them.

                      BTW (and sorry but I should know this) but is the 10 round limit for handguns equivalent to the 10 round limit for long guns? I ask because it seems to be legal to block the additional capacity of a long gun magazine thus allowing them to be purchased as a 'kit' and adding a permanent blocking device before assembling the kit. So, does the transitive law of limited magazines apply? That is, if you could buy a regular (i.e. greater than 10 round) capacity magazine kit and then block it to 10, is it CA law compliant?

                        Here is what I heard from an online store when I was trying to buy a SP2022 with high cap mags:

                        "We don't offer 10 rd magazines for this gun, therefore per our Terms & Conditions page, we remove all magazines with high capacity to CA. The exception to this is if you have an FFL who has a High Cap Mag Permit and is willing to pin the mag for you."

                        And my FFL is willing to pin the mags for $10 each.

                            You have to make sure that the model # is the same between both versions, usually they are not and that may cause you problems.
