    Quick inheritance question...

    I recently inherited a few firearms and when added with my own I've decided to keep a few with sentimental value and restructure my collection.


    Do I have to wait for my doj confirmation letter after I submit the forms before I start selling? Do I have to submit the forms if I'm not keeping them?

    No, you do not have to wait.

    Yes, you do have to file.

    New residents get a choice of file or sell, but inheritance/other operation of law does not get the choice.

      While I have your attention Librarian, Is there a time limit to submit the forms? If I'm going to turn in a raw receiver do I have to cut it with a torch or can it be as is? Does the department I turn it into matter?

        Time limit = within 30 days of receiving the handguns.

          Augh! There is a Disturbance in the Force!

          Turning it in to someone actually is not one of the options that the Legislature envisioned:
          Any person who obtains title to an assault weapon registered
          under this article or that was possessed pursuant to subdivision (a)
          of Section 30630 by bequest or intestate succession shall, within 90
          days, do one or more of the following:
          (a) Render the weapon permanently inoperable.
          (b) Sell the weapon to a licensed gun dealer.
          (c) Obtain a permit from the Department of Justice in the same
          manner as specified in Article 3 (commencing with Section 32650) of
          Chapter 6.
          (d) Remove the weapon from this state.
          Strip the lower so it's bare. All the other parts are just parts - stock, upper, whatnot.

          You then have 90 days to figure out what you will do.

          If you cut it up, you satisfy (a) and you're done. Don't know how that gets documented.

          If you're going to turn it in (I suppose they'll take it/them), call ahead to your local PD and tell them. Coming up to the front desk with a bag and announcing 'I have three ASSAULT WEAPONS!!!' is not going to work well. Get a receipt; probably want to prepare it yourself to be sure make/model/serial are all correct.

          With current availability and prices, it will be a while before you can get a replacement lower to re-build the parts back into a rifle. That suggests selling it/them to a dealer (has to have the 'assault weapon' license) might make sense, since there is currently an out of state market for lowers that we cannot buy/sell inside CA.
