    New Here, off list gun question

    Ok, I've live in CA for quite some time and I'm now starting to realize how utterly stupid CA gun laws are.

    In a nutshell, I want a gun that is off list (S&W M&P 40 Pro Series 5" Barrel). I have no idea why this gun is illegal but it is for some stupid reason.

    It looks almost identical to the CA legal version (short barrel, not the pro series) so what are the chances that I would get in trouble for having it at a range? I have relatives in other states that could purchase it but I understand it would be illegal for me to bring it across state lines. Any loopholes I can use to get this gun (without having to do some stupid single shot mod or anything that would cripple the gun)?

    Is it illegal to possess off list guns in California or is it just impossible to buy them? If I used a 10rd mag, would I be left alone?

    It is not illegal to possess them. You certainly wouldn't be hassled for having one at a range. You can buy one from a private party legally, although it would probably take a while to find someone selling one. SSE isn't that bad, have you researched it at all? I've gotten a new off list pistol this way. The mod isn't permanent, it is perfectly legal to change it back to original after you buy it and return SSE parts to shop that modified it (that is how the SSE process works).

      Here read this and then look for a shop that does SSE.



      Oh and like gunner said, off roster guns are not illegal to own as long as they comply with the AW laws.

        Ok so what about the family transfer method? Lets say my father purchases a gun out of state which is off list. He can give me the gun and I can legally possess it even though I could not legally purchase it here. So all he needs to do is get it into California without getting caught and he can legally transfer it over to me? God this is confusing.

          You need to slow down. Any time there is a step along the way that is illegal, you just don't do it.

          There are multiple ways to get what you want in brand new condition. Read the sticky about SSE. Read about how intrafamily transfer works. Read how PPT works.

          What you want is legal, you can legally have it, you can legally shoot it, there is no gray area about legality of possession of the gun you want. Just make sure that you follow one of the established paths and you'll be good to go.

          Frustrating? Yes. Complicated? Somewhat. That's CA.

              The State of California, doesn't trust you with certain guns.

              For example, the S&W M&P9 in black color is safe for you to have.

              However, the S&W M&P9 in Dark Earth color is far to dangerous and you simply can't be trusted with it.

              The State of California doesn't trust you with many items that other states trust their citizens with.

              Your second amendment rights are devalued and tightly controlled. However, if you are an illegal alien, then you are accepted with open arms and given sanctuary, a drivers license, a free education, housing, food, clothes... etc. If you are a legal citizen with a legal gun and carry it in public illegally (because you are not allowed to open carry and only a hand full of people are trusted with LTC), it is a felony and you will be prosecuted to the fullest extent of the law.

              Clearly no double standard there.

              To be honest, if you can, leave the State of California. People have been waiting for decades donating tens of thousands of dollars to no avail. Maybe a small victory here for there or a temporary stay from a most certain fate.

              Take your hard earn tax dollars out of this state.

                Thanks for the replies. I've read into the single shot exemption but I think the interfamilial transfer would be cheaper.

                Its not on the list for some reason.

                I am living in Texas at the moment (college) and I will probably stay for a few more years so I could register for a Texas ID that would allow me to purchase a handgun. I will have to move back to CA eventually (film biz) and I would like to bring my gun with me.

                Is this legal? Keep in mind that I would still be a CA resident, just moving back.

                Would it be easier to ship the gun to my father (overseen by FFL) and then repossess it when I return?

                I have read the material but it is still confusing. Is it illegal to drive an off list gun across CA state lines?

                As I read the laws, it is only illegal for a shop to sell me an off list gun but I can not get in trouble for having one in my posession.

                What am I missing?

                  Just focus on the bold part - that's correct.

                  If you can buy a gun in Texas, you must be a resident of Texas - need to worry about what Texas wants for that.

                    If you purchase legally in Texas then move to or back to California then your good to go you just need to register it here.

                      The key to remember is that (1) magazines over 10 rounds, and (2) threaded barrels, are the two most common restrictions that determine legality of a firearm (excluding AR/AK variants and pre-ban magazines).
