My step father wants to give me a handgun. I am way over the age of 21 and have a California hand gun safety permit. Is there any kind of paper work that I or my step father have to fill out to make this legal? I am thinking it is legal for him just to give me the handgun without any paper work. Anybody out there know for sure?

My step father is not my adopted father, I lived with him and my mother from when I was 7 years old until I was 21 and joined Corps. I don't think you will be able to do it then. He needs to be your legal father. I don't know if it is legal for him to intra to your mother (if they are still married) and then for your mother to intra to you. It would certainly be suspicious if you submitted the forms in quick succession (and your mom would need an HSC).Thanks for the quick reply and link. I have a new question for you. The other (better) alternative is to do an adult adoption. Yes you can do that, my girlfriend had it done with her stepfather. Just get a lawyer who does some family law work. It's mainly just some paperwork and a short court appearance and then the judge whisks his wand and he's your legal father. Also, there may be some advantages other than the gun transfer for an adult adoption (i.e. inheritance, medical care / authorization if both your parents get injured, etc.).The above does not constitute legal advice. OR:
Mom gets HSC, stepdad to mom via IFT, Mom to son via IFT
OR:
Stepfather performs legal adult adoption of stepson, then transfers gun to stepson via IFT
But NO he can not just hand it over without any legalities involved. The above assumes all parties reside in CA.The one thing worse than defeat is surrender.Comment
