    ar pistol legality questions

    Is it illegal to have a pistol upper without a pistol lower?
    (say you come on a deal too good to pass up for a pistol upper for example)
    and lets say your other AR's are fully built and put together so there is no un-built lower or a lower without an upper on it in your possession, (with intent to do an 80% build in the future)

    Yes it's illegal. Constructive posession of a SBR.

      ok, so if I plan on doing a pistol build, wait until the 80% is finished before shopping for used uppers?
      (again, all ar's in possession are fully built, not like there is a lower and upper next to each other ready to go)

        Yes.

        Acquire the completed pistol receiver, before you acquire the less than 16" barrel.

            A simple virgin lower (no matter how it was DROSed) will keep you from federal constructive possession laws. Ca laws are unclear on this though.

              if you found a great deal
              have a buddy buy it that doesn't have an ar get it.
              when you get your receiver done buy it from him.
              hard to pass up a deal

                  Interesting thoughts here as I want to build a pistol, but a stripped pistol lower can not leave a gun shop without a letter, it has to be a completely built weapon to leave the shop. The shop I deal with says bring us the upper, and we'll put it together and DROS it as a pistol. Yet if I am to bring them a compeleted upper and I already have rifles, that creates a bit of a problem according to these replies.
