Is it legal for a California resident to buy a handgun from an individual in a different state when that handgun is less than 50 years old (No C&R) and not on the CADOJ approved list. The handgun is not a currently made model and dates from the 1960's-1980's.

If this is legal does the CA resident simply have their local FFL file a DROS and handle the transfer?

If you're LEO, yes. Otherwise, no.

The CA resident can buy it but the local FFL wouldn't be able to deliver it to him/her unless they are a LEO. Non-roster handguns cannot be transfered to CA residents unless they are one of the exempted folk (like LEO). I think Wes at 10% had a thread on here not too long ago about just such an occurance. The gun would sit at the FFLs until the owner either sold it to a LEO or sold it out of state. Bottom line.....why bother.

That really sucks.

The two guns I want to get (S&W M30 & M31 - both .32 S&W long) are not on the CADOJ approved list. They are not on the BATF C&R list either. Which means the only way I can obtain either of them is from a internal CA PTP (snowball chance in hell of that happening) or if I limit the purchases to those M30's and M31's actually produced in 1957 (1st year) which would make them 50 years old and auto-qualify as a C&R. These two models were produced from 1957 to 1974 and 1991 so I am forced to find a low serial number first year model which will prove less than easy and not inexpensive.

Every day I hate this f'in state more and more.

Single shot pistol (with some restrictions) and Orimpic pistol (with a lot of restrictions) are also exempt.

Yeah it is a stupid law, most of the handguns I want were made from the early post WWII period up to around 1985 or so. The three that are at the top of my want list right now are a S&W 29-2 8 3/8in. in Blue, Walther ppk .22lr alloy frame, and I would really like another HK P9s. This stuff is here already but the finding it is the hard part now.
