Regarding 30 days rule.

Hi everyone, I got a technical question. I already purchased a Ruger as a new item last week. Now I see something I like on gunbroker and want it shipped to FFL. Does the online sale apply to the 30 days rule?

Yes, it will apply to the 30 day rule. Depending on the FFL, you might be able to purchase it and have your FFL hold the firearm until you can DROS it.

Is it the date you fill out the paperwork, the date you pick up, or way back when the date you paid a deposit, or paid in full for the gun?

Face to Face transactions, commonly known as PPTs, are exempt. If you have an 03 Curio license, I believe you are exempt from the 1-in-30 rule as well.

3. Heck ya, little difference makes a huge difference. So clarify with out examples: DROS paperwork date - 30 days - another DROS date.

Does not matter when you started the order, payment or shipping of the second handgun. And technically you can pick up your first handgun from gun jail the same day you start another one if your FFL allows a pick up of up to 30 days as mine.

Gotta have the COE with that C&R to exempt from 1 in 30. And, there are a few localities (like City of LA) that have their own 1 in 30 rule.

You also need to have a California Certificate of Exemption (COE) along with your 03 FFL to be able to DROS more than one handgun every 30 days. when doing the DROS make sure you tell the guy behind the counter to select under exemptions "1 in 30 day exempt" NOT "collector".

OP, Buy it!

By the time it gets paid for, FFLs exchanged, shipping it will be about time to DROS another. If you were really far out (like 5 DROS deep) I would recommend finding an FFL that doesn't charge storage - some will after 30 days.

I have 5 DROS waiting for me once I get back to the West Coast next week (but I also have my 03 + COE).

This question is an FAQ.

Let me summarize only the correct answers:

1) The 30 days starts with the date and time the DROS is submitted by the FFL. That's the only notification the state gets, so that's all they can use.

2) Except if you live in the city of LA, 1-in-30 applies only to handguns you buy directly from a dealer.

3) If you buy the handgun from another non-FFL, and use the dealer because CA says you must, that's a PPT - Private Party Transfer - and 1-in-30 does NOT apply - EXCEPT in the city of LA, that has its own 1-in-30 that applies to all handgun sales inside the city.

4) As noted, if you have your C&R FFL and you have the state COE, you are exempt from 1-in-30; don't let anyone tell you that applies only to C&R handguns - the law doesn't say that.

(But what if you buy a gun at a city of LA FFL and you have your C&R and COE? I really don't know.)
