    ND scenario

    What if someone borrows your gun and NDs it. Will the owner of the gun suffer the consequences ? Will the owner get the gun back? What if it happens on the owner's property or off the one's property ?

    Seems unfair if the owner of the gun would be in fault at all.

    At minimum, I'd make sure that they had an HSC. This is America, and you're subject to being held accountable and sued for anything.

      Given you're in one of the centers of liberalism in the state, I'd expect that you as well as the borrower would be sued in civil court. I'd guess you gun would be a goner... .

      Property owner would probably be dragged into court...above assumes the ND bullet caused property and/or personal injury.

      Without injury, cops would probably show up and confusion and confiscation and arrest(s) would ensure.

      This is a question best asked of a practicing attorney, not someone like me w/o law degree or experience in matters like this.

      Care to state why you're asking? Inquiring minds, etc.

        You open yourself upto civil liability for sure. Not sure about criminal liability. But they will take the gun for the period of the investigation. Fair has nothing to do with it. Loaning a gun is a bad idea.

            I agree with tactical city. Loaning guns is a bad idea, and if what a former FFL (not a gunstore clerk) told me was true, if an owner loan's a gun for a period of time more than 30 days, the owner must notify the CaDOJ or risk a felony charge. I'm not sure how Law enforcement would find out, but the way I see, your guns are your guns. Even if someone used my gun I had rightfully loaned them in a justified shooting, I would get a lot more attention than I would want.

            Hopefully I added some more information into the conversation instead of parroting everybody else.

              Not sure if you have to notify the DOJ, but I do know that you can loan your firearm to someone for a period that is not to exceed 30 days.

                This is true.

                My contact (a former FFL and current lawyer) also expressed to me loaning a pistol over a month will require the owner notifying the CaDOJ. Take it with a grain of salt. FFLs are generally very paranoid, and will err on the side of caution

                  Regardless of the law, I would not loan my firearms to anyone without my presence. It's just too risky.

                    Risk being a non-issue, I simply do not like anyone handling my firearms, or feeding my firearms ammunition I do not approve of. Lesson learned after loaning my brother my 1911.

                      Most of us wouldn't loan our car out, in case it gets damaged or is involved in an accident...I'm assuming it's the same with our guns.

                          Didn't read replies cause I'm pretty busy. I just wanted to say that I was curious about what would happen because of the the recent ND thread.

                          No one that I know borrowed or ND my guns.
