When committing a felony, different constructions of loaded apply.
In your scenario, the magazines can be loaded because loaded magazines are not controlled - only loaded firearms.

so hoffmang, if the magazines are in a separate compartment from the ammo, that means it's controlled?
i guess the confusion is the word container. some seem to interpret it as absolute, i.e. container only and no container in another container. though with that absolute interpretation, that means no ammo can be stored in your locked trunk because a lock trunk is also a container. so what's the interpretation when you have container w/in a container w/in a container type situation? (plastic hard case for handgun inside a soft case inside a car trunk).
jakemcoy, your comment doesn't seem to be consistent in your definition. the cable lock is an approved gun lock when i picked up my handguns. why would a padlock be any better especially if it's not doj approved?
look, i'm not being a pita here. but basically trying to understand and yes, avoid a felony. i'm not sure about you guys, but many times i got to the range, i see many doing the same thing - hard gun case in soft case inside a bag with ammo in it. though some, i do notice they "unlock" their hard gun case. not sure if y'all notice that. that's a lot of felonies i see there.Last edited by high_revs; 01-02-2008, 8:37 AM.Comment

omg i cant believe this thread. for years i would put a lock on my handgun. wrap it in a towel. Then put it in my tackle box. then put a lock on my tackle box then put it in my trunk. Now the other habit i started was puttin the ammo in the back seat. case closed. Now a days i put the handgun with about 4 total handguns in a gun carrying case. They all have locks on them. the case has a lock 99 cent cheap azzz lock on it. then i put it in the trunk. 99 cent lock due to its just transporting to the range. At home they are in the Safe.sigpicComment

Where does it say in the Penal Code that you can't have loaded magazines in the same locked container as the unloaded handgun? The answer is that it does not. I often put an OLL, 2 large-cap magazines for it seperate, a P226, and two loaded magazines for it in one rifle case with a padlock on it. Exactly!
I would suggest, though, unless your mags are in a fixed slot or holder in the case that you put an empty magazine in the firearm, to prevent the loaded ones from wiggling into the gun, just as a precaution.

As long as the case around it locks up such that it would take more than no force application to open without a key or combo, yes.
