    Gun Lock Receipt Question

I just posted this in another thread: http://www.calguns.net/calgunforum/s...d.php?t=531981
But I thought I should just start a new topic, for my question.

I am going to pick up a gun from a FFL where I did a PPT.
The dealer told me that I can sell an existing cable lock I already own to a friend, then buy it back from them. All I need to do is write up a simple hand-written receipt with the friend's signature, acknowledging the sale. As long as the sale is within the thirty-day window, it's legal.

    Does this sound right?

It's up to your FFL...he is the one who told you that he will accept this so you are good to go.

Thanks. Actually, I probably should have phrased my question a little differently. Just to make sure things go smoothly, is there any common information that would also need to be written on said receipt? Or is just the purchase price, date, and seller's signature all that would be needed?

You need a receipt for the lock, there is no requirement that I know of regarding whether the lock is new or used, bought from a store or a private party. It would need a date on it and an amount, since you have to buy it. Receipts don't normally have signature, although it does have the name of who you bought it from.

Regardless of new or used you can simply ask a friend to "sell" you one.

Just make a written receipt that's dated within the 30 days showing proof that you've purchased one, your local firearm store will make a copy of it and file it.

Date, Amount, and make sure it is a “CA DOJ approved lock" - for example if its a red glock lock the receipt should include: “CL551B - CA DOJ approved safety device”

Some FFLs are REAL sticklers about this.

                gun lock

If you are in Fresno, come by the NE police station M-Th 0700-1600 and I will give u a CA approved lock for free. With my business card and a current DOJ list confirmation printout will work per DOJ in lieu of purchase. I only have 100 on hand, so I should have enough for the next few days..

BTW, call first to make sure I am there before coming over since the station is closed to the public. I will be out Monday and will be in and out Tuesday. The District station # is 559-621-6400 or PM me and I will give you my work email (easiest way to get me).

Im a noob so im not sure if im understanding this conversation:
Is it required for the dealer to show that you own a CA DOJ cable lock before you walk out the door with your handgun?

There is a state requirement and a federal requirement (which has not been published, as required). The state requires that the person have a CA certified lock, certified lock box or safe. If the buyer brings a lock, then a receipt within 30 days is required. If the firearm comes with a lock, then no receipt is needed. A receipt is needed for the lock box. No receipt is required for the safe, but for both the lock box and the safe, an affidavit needs to be filled out.

For the Feds, it is a bit different. The BATF lawyer I talked to said that the FFL had to provide a lock or safe for a handgun. No receipt is required though. Under this view, it means that all handguns have to leave with a lock, but there is no paperwork requirements and I was also told that agents are to only do something if they actually see a handgun leaving without a lock or a safe. The lawyer's view was that the buyer could not bring the lock as the FFL had to provide the lock (although a lock exchange would work). The law says that safe storage has to be provided and it is unclear by whom.

i just did this with a friend countersigning. I simply drafted up a Bill of Sale stating the following, dealer accepted it no problem:

I, (seller's name), hereby transfer and convey ownership in one (1) gun lock (you can state type, I didn't get that specific) on (date) for the purchase price of $1.00.

                          Seller's Signature Date

                          Buyer's Signature Date

It's pretty ridiculous that we have to go through all this monkey motion to get our guns...I seriously doubt that this is making us any safer...good luck!
