Another 10 day wait for MFG replacement??30day limit?

I sent a BNIB gun back to the MFG for repair. They called and said they want to replace the gun, but because it has a different serial number they have to ship it to the FFL. Good enough so far. I go to the gun shop that I bought it from, after a 20 minute wait I was told that they will receive it (oh thanks ) but I have to pay DROS again and wait 10 days to pick it up. This is for a gun I have not shot yet and went back the day after I got it.
Have you ever had to pay and wait again for a defective replacement by manufacturer? Does this mean that I now loose one 30 day limit since the last buy?

This seems like a horror story to me. What was wrong with the first gun? Did you even inspect it before going to DROS the first time?

      Yes and Yes.

Sorry but at least they are replacing your gun.

Sorry, but don't keep us in suspense...what gun, and what was wrong.

Should fall under this exemption, but I believe you need to pay to re-dros.

How do I handle the paperwork when a purchaser returns a defective firearm?

If a firearm is brought to you for service or repair, you may return it to the person who submitted it for repair without undergoing the DROS process. If the firearm must be replaced, a new DROS is required. There is an exemption from the one-handgun-per-month restriction for exchanged handguns.

If the gun is so bad it had to be replaced by the manufacturer without having fired it, the OP should rethink whether this gun is worth it. Of course, when threads like this comes up the gun and manufacturer is never mentioned.

read the rest of the exemption. He's not talking about being exempt from DROS, it clearly says he's exempt from 1in30.

              MFG

Since there is interest, the gun was a Sig 1911 x0. The barrel looked like a reject and/or a beaver on kryptonite chewed on it. Sig finally replaced it after 6 weeks.

Has Sig offered to make up for the additional DROS by sending you extra magazines or accessories?

i'm sure a complaint to customer service should take care of this. Ask for more mags to offset the cost of the new DROS and the time spent waiting for a working gun.

Can't wait until CGF gets their day in court later this year to remove the 10 day wait for subsequent firearms purchases...would make debacles like this easier to deal with!

I had to go through the same thing when S&W replaced a cracked frame on my old 637-2.
And no, they don't compensate for the costs. It's not their fault CA is the way they are with gun laws.

Yes, RIA did it to me.

There should be an exemption for this. To have to wait 10 days + shipping back to mfg and mfg warranty process + return shipping + another ten day wait topped off by another $25 is ridiculous. What purpose does it serve?

Don't take this as a California only-matter either. It is Federal regulations under the Brady Law which state that anytime a weapon enters custody of an FFL a background check with an attendant 4473 form must be accomplished before said weapon can be transferred to the owner. Up here in South Dakota I found that out the hard way after the owner gave me a 4473 when one of my handguns came back from an out-of-state gunsmith.

Thus in your state we have the 10 day waiting period and DROS on a weapon already owned by the OP.Its likely even if the weapon wasn't replaced the same process would be required.

The 1911 may have been in wars for 100 years, but Masetro Bartolomeo Beretta was arming the world 400 years before John Browning was ever a wet dream.

                            got it back

The gun came back with nothing extra.
I had to make more than a half dozen calls and deal with the nasty, I mean nasty with attitude, customer service of Sig Sauer (one of the CS reps hung up on me while I was explaining the problem, wished I remembered her name), write a few letters and fax a complain to the president of the company and being without a new gun for six weeks after purchase. to give credit where it is due, the grand supervisor who called back tried to be nice and accomodating.
Just because there are laws about guns, it does not mean the customer has to be punished or inconvenienced. These are $1000 plus purchases not six packs of diet coke. The MFG should be more than greatful that you spent your money on their brand. Most of us need another firearm like a 3rd or 4th porch around the house.
On the same note, I had to call Springfield Armory for a 1911 return and repair. What a pleasant experience, and I mean that. The nicest CS I have talked to in along time. Informed and familiar with what you are talking about as well as really interested in making things right because it should have been right to begin with. SA's customer service was really impressive and I am sure I'll buy a few more of their 1911s.

One of the main reasons I chose S-A over a Sig 1911. I bought a used 1911 Mil-Spec in 2005 and it dveleped a very loose barrel bushing after lots of hard use that summer.
I called CS and talked to the nicest woman on the phone. "Sure honey we will take care of it for you" She then offered my as many magazines as I wanted to buy at the discounted price they offer you when you first buy a new gun.
