there is no requirement that it not have a gas tube.

SSE handguns are sold everyday in CA with functioning recoil systems. A self-ejecting single-shot handgun is still SSE if it is dimensionally-compliant.

I go with the "better safe than sorry" mentality. No requirement, your right. I just don't want to ever give up my rights to own a gun on a technicality.
