Hello, new here. I am a PO, I would like to sell a NON ca approved 44 smith and wesson to a buddy that is not a PO. I was told I can because I bought it first. This true. I want everything to be on the up and up here.

Non-rostered pistols for sale are only possible through a private sale or through an LEO to civi sale.sigpicComment

The approved list only applies to sales from an FFL to a non-exempt (e.g. non law enforcement) person. That's it. Has nothing to do with a gun's legality or the ability to sell it via private sales, etc etc etc. You're fine.Comment

Is there a limit to how many off-roster handguns an LEO can sell to non-LEO folks? This story that's currently running on Fox caught my attention. It seems like these Sheriff's deputies bought (large?) quantities of off-roster handguns and sold to non-LEOs, but now they are being investigated by BATFE.
Also, would the non-LEO purchasers face any repercussions of this type of investigation? I assume that the firearms in question were legally transferred.Comment

Roster exempt.
The Roster basically is a gating element for (re)selling handguns
that the FFL himself acquires. However, Roster does not apply to
consignment sales. - People - regardless of LEO status - should not sell handguns, even
though required CA FFL is used - in over 5 transactions per year.
Note that the transaciton count is limited, not the actual number of handguns.

Given the BATFE is involved, and the BATFE doesn't give a rat's patootie about the roster (though they do insist that California law be followed)... I suspect that their primary interest is in the resales exceeding "infrequent"- Rich

as long as you & your friend go to a FFL together and you sell it to him/her via a Private Party Transfer (PPT), which should be a $35 transfer fee to the FFL wherever you go, you should be good to go.Comment

I see a future in a website dedicated to "CA LEOs wishing to advertise their excess firearms for sale".
