    HELP with trading gun

    I have just recently purchased a handgun and I know that CA has a 30 day limit in between purchases for buying another handgun. I am interested in trading my p229 to someone who lives in Texas, would this trade be considered a "purchase"?

    Need some more info. When you say trade does that mean he gets your Sig & you get his handgun? Since he's in TX and you're in CA, the gun would have to go through a CA FFL dealer.

    You need to be certain the handgun is on the "not unsafe" list & can be imported into CA. If it can be imported, I believe the transaction from FFL to you is listed as a dealer sale and does count as a "one per 30". If the handgun you purchased fewer than 30 days ago was not a PPT you'll have to wait, but if eveything else is OK you can still do the deal. Maybe I'm wrong, but I'd assume you can not do a "private party transfer" with the resident of another state.

      Yeah I would be giving him my sig and recieving his HK p2000. I was thinking the same thing that it DID count as the one per 30. Could I have my brother do the trade for me and then do a PPT from my brother to myself?

        Be aware that the PPT between you and your brother are not considered intrafamiliar transfer, you would have to go through FFL with associated fees, waiting period, etc.

          In general (without any other stuff - like LEO) ONLY PPT's are exempt from the 30 day restriction. This transaction would not be a PPT as he would not be present at the transfer. You could still do the transaction and just have your FFL hold it for the 30 days to end. Every FFL I know is fine with this.

          You could have your brother do it, but this would cost an additional $35 and you'd still have to wait his 10 days before you could do the PPT.
