    According to CA Law, shipping handguns illegal...read this

    My FFL referred me to this...the CA 2005 handbook

    Scroll down to page 48. (It's page 48 as numbered in the notebool, as your computer tracks pages in the scroll bar it's page 54).



    Is this incorrect?

    The text I see just refers to US Mail:
    "Handguns may not be sent through the US Postal Service."

    That just means FedEx/UPS/DHL your handgun to an FFL overnight.

    BTW, that statement is not quite correct, either: an FFL can certainly mail handguns via US Mail.

      Use of United States Postal Service, Private Parcel Delivery, or Common Carrier

      Long guns may be mailed through the U.S. Postal Service, as well as most private parcel delivery services or common carriers. Handguns may not be sent through the U.S. Postal Service. A common or contract carrier must be used for shipment of handguns.
      It means that as an individual, you cannot use the US Postal Service to ship a handgun. (As a licensed dealer you can, and the recipient must also be a licensed dealer.) A common or contract carrier means services such as FedEx, UPS, DHL, and so on. But, they can be used only if their policies allow shipping of handguns, and you must follow their procedures. DHL does not accept handguns for shipping, and when using FedEx or UPS, they require next-day delivery service.

        Sorry, my post was meant to address the USPS issue only...doing many things at once here, evidently this one none too well.

        My understanding was FFLs can ship handguns USPS. Us peons need to overnight Fed-Ex or UPS.

        The issue is my FFL needs to send a gun back for me...and he believes he can't do it USPS...and that manual by the DOJ doesn't help.

        So I call the DOJs main number and the lady that answered doesn't know either (go figure). She fumbles around and reads me exactly what it says in the book...so much for expert advice.

        If there is an FFL here willing to let my FFL call you that would be great.

        I'd rather not eat 40-50 in shipping when it can be done much less.

          It's sort of scary to imagine that there are dealers out there that don't know this stuff...

              Thanks, but he has the handgun and I need to convince him it's legal to ship USPS...so if anyone here is an FFL and willing to tell him via phone PM me,,,

                He can call me.. I use priority flat rate. I also recieve firearms via usps all the time. Untill the post office gave RSR a hard tim all my handguns came via USPS priority mail.

                  In the atf green book on page 139 shipping usps is covered at the bottom right hand corner.

                  atf and post office are both the feds... if he's using the CA abrievviated guid it stinks.. it's easy to read but it's oversimplified.

                    Not to hijack this post, but when I was 19, my friends father (a so called kitchen table dealer) sold us new hand guns - this was back in the mid 80's. At the time I asked him if we needed to be 21. He opened several thick books and finds nothing on this, so he say's its ok.

                    11/2 years later, he calls me up to say he needs the gun back from me and the other guy. He says DOJ, via the County Sherrif are on him for selling handguns to minors - we needed to be 21 He offered to buy it back, but luckily it was only a few months till I was 21, so I had him hang on to it.

                    The point its, the laws are so vast, that there are always errors - how do you think the DOJ makes money - through fines.
