    My CCW instructor told the class.....

    Well I finally got around to taking my CCW class, it was a small class with only five students and a local CCW instructor who comes highly recommended from many folks here on this sight, well it was late in the class when one of the other students asked the age old question, "hey teacher, when I'm traveling with a gun in my car, (no CCW permit) where does the ammo have to be?"

    The instructor replied, it has to be in two different areas in the car , well I looked up, and I said are you sure? he said yep, I said ummm, while thinking, ok do I speak up or just shut my mouth and wait for it to be over? after all, who am I? this guys been teaching gun laws for most of his life, do I really think he's going to listen to any thing I say ? I said ohhh

    He said oh no, you cant have ammo or a loaded mag in the same compartment as the gun, that's a FELONY!!

    He also said open carrying a firearm with, I believe he said, ammo or a loaded mag in your possession is also a FELONY!

        Very important.........this does not make that instructor stupid.

        Merely uninformed and over officious. It is true the two can be confused.

          You could ask him to join Calguns, or at least read the Wiki article on "what is loaded?" or refer him to Machtinger's book 'How to own a gun in California'.

          It would sure be nice to extinguish that old incorrect idea.

            I think I would have approached him after class and one on one.

            Would have to take the diplomatic approach and see how the 'Instructor' rolls with it.

            If the Instructor in interested in learning, there ya go!

            If the Instructor takes the defensive... walk away.

            You would be doing the gentleman a favor either way... capiche?

              Not the same level, but I heard a guy at a shooting range tell a guy the same thing the other day, he then went into loving detail about how if HE were a cop and HE caught the guy with a full mag in the box he would confiscate the gun and blah blah...

                Was this at "The Range" in Fresno, with someone on their staff? Or somewhere/somebody else?

                  I was wondering how the instructor felt when we arrived at the range, and he watched me pull my four pistols, and eight loaded mags out of the same bag???

                      I thought not. If by chance it were though, I was going to suggest you talk with Ron the owner who is an attorney and could give you the straight info.

                      I took the class with Will and it was professional and informative. A portion of the training was Ron Sawl giving great legal vs. real life info. I could be wrong, but I think they told us that yes, legally you can carry in the same container, but you may just want to keep them seperate anyway.

                        I disagree. It's part of his job to teach the applicable laws regarding firearms and use of force. If he's teaching people that carrying loaded mags while UOC'ing is illegal and that ammo has to be stored separate from the gun, what else is he teaching incorrectly? Maybe he's teaching that you must retreat before defending yourself outside your home, as many seem to think. People are responsible for knowing the laws, just like the OP, which is why he knew the instructer was incorrect. But it is stupid to teach things that are wrong, especially simple things like that. The issues of carrying loaded mags while UOC'ing and transporting ammo/guns are the some of the lesser complicated laws. Bottem line, his job is to teach tactics, techniques, and the legalities of firearms/deadly force. Such basic mistakes as the ones he made call into question his reliability.

                          rugershooter, like I said, it doesn't make him stupid, which might be an important tack to take while correcting him.

                          Remember, PC only tells you what not to do, so it is not going to say it is ok to have ammo with (not in) the gun. Case law has defined it. The CHP faq is a great resource, but some "experts" scoff at that too, but not on this site that I know of.

                            Flame suit on and just playing the devil's advocate... A lot of cops will still give you trouble if the loaded mags are in the same container as the firearm from what I understand.

                              I've learned to not call instructors out during a class unless you really know them. It's much better to wait until afterwards and then let them know about any discrepancies and offer to show them why you feel they're wrong.
