Intrafamilial Transfer Clarification

Hi fellas... I need a bit of clarification on Intrafamilial Transfers.. I'm 20 years old and I have a couple handguns I need transfered to me from my dad. I was just going to wait till I turned 21 and do a PPT but then I heard about the intrafamilial transfers. So, I just fill out the one page sheet and send it to DOJ with 19 bucks? Does my dad need to sign anything or write his name down at all?? Also, this might be a stupid question, but will the guns actually be switched into my name or am I just letting them know I've taken possession?

You've got it.

Dad need not sign anything; remember that in this case it's $19 for all the handguns, not for each one, and long guns need no paper.

Gene said the other day that the database doesn't get changed to remove previous owners, so if that's important, file the NLIP forms for them. http://ag.ca.gov/firearms/forms/pdf/BOF4546NLIP0209.pdf

It is illegal for anyone under 21 to purchase a handgun. A transfer of a handgun from Dad to his 18-21 year old son is perfectly legal.

which form are you talking about? If you are talking about the intrafamily transfer form, which is what this thread is about, that is incorrect. An 18-year old CA-resident can receive a handgun from his CA-resident parent/grandparent and fill out the form and send it in. And its legal.

12078(c)(2) Subdivision (d) of Section 12072 shall not apply to the infrequent transfer of a handgun by gift, bequest, intestate succession, or other means by one individual to another if both individuals are members of the same immediate family and all of the following conditions are met:
(A) The person to whom the firearm is transferred shall, within 30 days of taking possession of the firearm, forward by prepaid mail or deliver in person to the Department of Justice, a report that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The report forms that individuals complete pursuant to this paragraph shall be provided to them by the Department of Justice.
(B) The person taking title to the firearm shall first obtain a basic firearms safety certificate. If taking possession on or after January 1, 2003, the person taking title to the firearm shall first obtain a handgun safety certificate.
(C) The person receiving the firearm is 18 years of age or older.

No FFL, no 10-day wait, and yes, this is the legal way for 18-19-20 to get handguns.

You didn't say - is Dad also a CA resident? If yes, all is as stated.

If NO, then you have a problem - interstate transfers must go through the CA FFL, and the CA FFL is prohibited from delivering handguns to under-21.

Wow! Thanks a lot fellas.. My dad and I are both CA residents.. I'll be filling out the paper work and sending it in tomorrow.. That's good to know about the long guns too, my dads been trying to get my 17 hmr from me for months. Haha
