Registering several pistols?

    Registering several pistols?

    I have a couple of pistols I need to register from moving out of state. Also, my dad has some pistols he never registered...can I register those at a later date w/o penalty?

    before you even say what kind of guns these are check to see if the state says they are legal here. (the doj has changed there minds before)

    but i would say what is family is family, not the states.


    not sure what the law says so i am not saying to break the law.

      If the pistols that YOU acquired were acquired while you were a resident of another state, you must register them with DOJ within 60 days of moving/returning to this state. As long as those pistols aren't AW's or have magazines imported into this state that are >10 round capacity, you should not have a problem.

      As far as your Dad's pistols are concerned, it depends upon your Dad's specific situation. Without more info, I can be of no further assistance.

          The DOJ has a form for such registrations... it is on their BoF website.

            These are the requirements if you move into the state with a handgun.

            (2)(A) On or after January 1, 1998, within 60 days of bringing a pistol, revolver, or other firearm capable of being concealed upon the person into this state, a personal handgun importer shall do one of the following:
            (i) Forward by prepaid mail or deliver in person
            to the Department of Justice, a report prescribed by the
            department including information concerning that
            individual and a description of the firearm in question.
            5588
            (ii) Sell or transfer the firearm in accordance
            with the provisions of subdivision (d) or in accordance
            with the provisions of an exemption from subdivision (d).
            (iii) Sell or transfer the firearm to a dealer
            licensed pursuant to Section 12071.
            (iv) Sell or transfer the firearm to a sheriff or
            police department.

            The form can be downloaded from the DOJ website.
            If you miss the 60 day deadline than:

            (4)(A) It is the intent of the Legislature that a
            violation of paragraph (2) or (3) shall not constitute a
            “continuing offense” and the statute of limitations for
            commencing a prosecution for a violation of paragraph
            (2) or (3) commences on the date that the applicable
            grace period specified in paragraph (2) or (3) expires.
            (B) Paragraphs (2) and (3) shall not apply to a
            person who reports his or her ownership of a pistol,
            revolver, or other firearm capable of being concealed
            upon the person after the applicable grace period
            specified in paragraph (2) or (3) expires if evidence of
            that violation arises only as the result of the person
            submitting the report described in paragraph (2) or (3).

            (g)(1) Except as provided in paragraph (2), (3),
            or (5), a violation of this section is a misdemeanor.

            So if you fill out the registration form from the DOJ, you are reporting that you missed the 60 day window. But as stated above their is no penalty if you report the failure to register during the 60 day window yourself. If you don't submit the paperwork and are caught with an unregistered gun that you brought into the state after Jan 1, 1998 then it is a misdemeanor.

                Read the bolded section that I wrote above.
                The law basicly states that you have 60 days to register your handguns upon moving into the state after Jan 1 of 1998.
                If you fail to register in that period and get caught it is a misdemeanor.
                If you get caught past the 60 day window because you are registering them, then there is no penalty.

                  DOJ wants you to register them. Therefore they will, I'm told, ignore the firearm's previous history (such as you registering them late) unless the guns are listed as stolen.

                  I've had handguns transferred to me that were not previously registered. There was absolutely no problem. THe FFL said that the DOJ didn't care where they came from, or that they hadn't been registered by previous owner.
