    LEM Transfer Question

    Ok, so i have read whatever posts i could find by using the "search", and i believe i have the correct answers. Just wanted to verify in case I missed something.

    Father out of state buys H&K HK45c, does FFL transfer to Ca and provides a written letter stating the firearm is a gift to me along with the firearm. I pay the transfer/dros fee upon arrival, wait 10 days and its good to go?

    The last time i dros'd a gun purchased from an out of state store i had to pay sales tax, but since this is a gift there will be no ca sales tax correct?

    I'm assuming he must ship the firearm from his local gun dealer?

    Opt B would be to have a LEO purchase the gun and do a PPT, but i think with sales tax, etc it would be more costly..

    sorry if this has been covered a 1000 times.. Any help is greatly appreciated.

    He doesn't need to ship the firearm from his local gun dealer unless your local FFL requires it. It's a matter of preference.

    If it's a gift, tax shouldn't be involved.

    Option B is consider a straw sale if the LEO buys it with the intention of transferring it to you.

      First of all, you should be sure the FFL your dad is going to ship to knows about the exemption and will process it for you. Next, ask the FFL if he will only accept shippments from other FFLs, or if it is ok for your dad to ship the gun straight to him/her. If he can ship directly, your dad doesn't need to use an FFL on his end, he can ship FedEx or UPS overnight (must be next day air and be shipped from shippers "hub", cannot be a postal annex store or something like that). This can be pricey...bout $75...but if he does use an FFL to ship...the FFL can use the US Postal Service to ship...much less expensive, but he/she will charge a transfer fee...so you may save $20 or so by using an FFL to ship to your FFL. Next, the letter your dad writes must have the "gift statement", and the make, model, and serial number of the gun he is gifting to you. You will not be charged tax, as you are not receiving the gun from a retailer.

        thank you very much for your quick and knowledgeable answers! Hopefully my local FFL doesn't require an out of state FFL to ship the gun as i get good UPS discounts on air packages through my business. Either way, its not a deal breaker.

        speaking of FFL's, what all is required in obtaining a license? I have a cnc machine shop and wouldn't mind exploring other business ventures. thanks again

          What are California's licensing requirements for firearms dealers?

          California firearms dealers must obtain and maintain the following:

          1. A valid FFL,
          2. A valid Seller's Permit issued by the State Board of Equalization,
          3. A valid COE issued by the DOJ,
          4. Any regulatory business license, or licenses, required by local government,
          5. A local license granted by the duly constituted licensing authority, valid for one year from the date of issuance, and in one of the following forms:
          1. In the form prescribed by the Attorney General;
          2. A regulatory or business license that states on its face, "Valid for Retail Sales of Firearms" and endorsed by the signature of the issuing authority; or
          3. A letter from the licensing authority stating that the jurisdiction does not require any form of regulatory or business license or does not otherwise restrict or regulate the sale of firearms. After obtaining the above licenses, an Application for Centralized List and appropriate fees are submitted to the DOJ. Upon approval of the application, the dealer will be given a CFD number and placed on the Centralized List of firearms dealers.
          6. A listing on the DOJ Centralized List of Firearms Dealers.
