Just out of curiosity can CDC correctional officers get LEO guns like the LCP?

My buddy is a CO and was talking about the LCP but he didnt know it was LEO and he doesnt really know the gun laws he just liked the pistol

Yes, California recognizes correctonal officers as LE-exempt for the list. He can get high cap mags, buy as many guns in 30 days as he wants, and is exempt from HSC as well.

But I got a CO friend who could not get a CCW in Sacramento, he said that he can not just carry a gun like other LEOs. So CO are not LEO ?

All California Correctional Officers are LEO. You don't have to apply for a CCW you can carry off duty. You are a sworn Peace Officer of the State of California. You passed your PC 832 and qualified with that antiquitated SW Model 10 38spl. All you need to do is qualify quartely with a range master with your choice of carry weapon. Thats basically any handgun you feel comfortable with.

I believe they are limited peace officers in that they only considered sworn peace officers while on duty and as such, cannot carry off duty and do not have peace officer powers when not in the job. Most CDC officers aren't even armed while on duty. Heck, even the transport officers are carrying CDC wheel guns. Nothing wrong with revolvers but it's a bit dated.

As far as being roster exempt, I can't speak to that but I think my late reading of it included them as exempt.

The following persons are peace officers whose authority
extends to any place in the state while engaged in the performance of
the duties of their respective employment and for the purpose of
carrying out the primary function of their employment or as required
under Sections 8597, 8598, and 8617 of the Government Code. Except as
specified in this section, these peace officers may carry firearms
only if authorized and under those terms and conditions specified by
their employing agency:

(c) The following persons may carry a firearm while not on duty: a
parole officer of the Department of Corrections or the Department of
the Youth Authority, a correctional officer or correctional
counselor employed by the Department of Corrections or any employee
of the Department of the Youth Authority having custody of wards or
any employee of the Department of Corrections designated by the
Director of Corrections.

There are employees of CDC, and then SO employees that man the county jails as CO's not sure if the policy is different for each one. The CO's at the county jail where I work (Imperial) seem to think they have to apply for CCW's. They are granted when they apply though...

Correctional Officers can also get a waiver. It is signed by the Warden.

I agree that parole agents are authorized to carry off duty and are CDCR employees and there may be other such employees authorized to carry off duty but it seems from 830.5 that it requires CDCR to designate them as authorized and that does not apply to all job classifications with CDCR. In the words, the regular mainline corrections officer, while a peace officer, cannot carry off duty without a CCW unless CDCR has authorized it.

At least that's my reading of 830.5 and the apparent limitations within. There must be a CDCR corrections officer here who can tell us what the policy is. I am regularly around CDCR officers so I'll ask when I'm back at work if no one chimes in.

As for California county sheriff's corrections officers, as differentiated from deputies assigned to the jail, they do have to apply for CCWs.
