    High capacity magazines

    I used the search feature, but nothing came up that really answered my question conclusively.

    School me on high capacity mags.

    Hi capacity handgun magazines (over ten rounds): Legal to possess (say in the case of an off roster handgun transferred via family), but illegal to buy or sell either PPT or FFL? True or false?

    You cannot transfer the ability to own hi cap magaines. basically if you bought them before the ban you can have them. You can rebuild them to keep them in working order but you cannot buy any more than you had before. If someone transfers a gun to you they retain the legal hi caps. You do not.
    What do you mean my birth certificate expired?

      only legal to possess if you had owned them prior to 2000 or if youre a leo.also if youre repairing previously owned magazines from 2000 or before.

                What if your LEO and want to sell your hi cap firearm to a civilian. Can you disassemble the mags and sell it with the firearm?

                  Yes. You can also order disassembled magazines from various websites or local stores.

                    The buyer can not reassemble them though. Also, I don't know of an exception which would allow an LOE to manufacture (assemble from a parts kit) or import +10 round mags into CA. I believe that LEOs are only legally buy them from someone permitted to sell them in CA.

                          Discussions of 'statute of limitations' are inappropriate in general, unless a poster has an actual ongoing legal problem, not the case here (and, quick referral to a lawyer is the right action). A statute of limitations applies only when some crime has actually been committed but the perpetrator has managed to avoid prosecution. Calguns members don't ordinarily admit they have committed crimes.

                          Discussions of 'finding' a large-capacity magazine don't usually pass the smell test; yes, it's possible, as some posters have stated it has happened to them. It's poor advice on Calguns - DOJ and other LEO read the board - and it needs to stop.

                          Yes, possession is not illegal, so something quite odd needs to happen to open a legal inquiry where the means and time of acquisition are questioned.

                          Yes, prosecution of a suspected violation of this silly law would probably be difficult; I've never kept a receipt for a magazine purchase, and do not plan to start.

                            LE can import them into the state, but we can not sell, give, furnish, etc to non-exempt individuals.

                            As a LEO, I can't let my non-LEO son borrow my 11+ rd mags to take to the range unless I am along for the ride. I have 10 rd mags for many of my guns for this stupid reason.

                            And yes, the law is STUPID and needs to GO AWAY!
