    Re-build kits?

    Can someone please explain to me what a high cap magazine re-build kit? Is it the magazine just disassembled?

        If you use them to assemble new magazines in California, it's a FELONY! But, you can use them to repair existing mags!

          So, let's say I have some high cap mags and would like to sell them with the gun. Can I sell them in CA if I disassemble them?

            I believe you can, If they will be used to repair/rebuild existing high cap mags.

              YES. Do you have a 10 round or less mag for it too? If so, advise the buyer that he should just take all the mag parts home and leave the lessor capacity mag with the gun in case he needs it to do a safe handling demonstration.

                No 10 rounders, just high caps. I'm a little reluctant to sell them on this forum because of this reason. I know I wouldn't have any problems if I just sold it to LEO's but that might take awhile.

                  Yes, yes, yes, yes. Sell as many the "Standard capacity" mag kits as you want. It's 100% legal.

                    No problem what so ever. Just an extra step for you to take the mag apart.

                      Here's the skinny...

                      PC 12020(a) says this w/ regard to large capacity magazines:
                      Any person in this state who does any of the following is punishable by imprisonment in a county jail not exceeding one year or in the state prison:
                      (2) Commencing January 1, 2000, manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, or lends, any large-capacity magazine.


                      So you need to disassemble the magazines which will make them parts kits. If the recipient isn't eligible, they can't just assemble them willy nilly. They do so because they're repairing/replacing an existing magazine that was already legally owned.

                      If you don't have 10 round magazines, make sure the buyer provides them at the time they need to do the safe handling demonstration to the FFL.

                      Lastly, the word felony gets tossed around a lot because it's scary but the PC explicitly says imprisonment for no longer than 1 year. My non-lawyer understanding is that's actually a misdemeanor, though I wouldn't want either on my record. Those in the 2A forum will probably clarify or elaborate on that if needed.

                        I wouldn't sell them unless you absolutely have to. It's not like you can replace them once you've sold them. You might buy a gun that uses the same mags in the future, and wouldn't it be nice if you already had standard capacity mags for it?

                        I have mags for the guns I don't even own yet (and for some that I probably won't own, as my taste has changed in the last decade).

                              Repairing existing large-capacity magazines

                              In a letter dated November 10, 2005, Deputy Attorney General Alison Merrilees answered a list of questions about the legality of repairing and replacing parts of legally possessed large-capacity magazines.

                              The letter clarifies that it is legal to replace parts of a legally possessed large-capacity magazine with parts of any vintage. It also states that the possession, sale, or import of all the parts of an otherwise prohibited large-capacity magazine is not illegal though assembling them into a new large-capacity magazine would be a crime.

                              The general rules regarding magazine repair appear to be that as long as one ends up with the same number of legally possessed large-capacity magazines, has a plausible path of replacement parts from the original possessed large-capacity magazine to the repaired magazine, and the magazine continues to work in the firearm it was originally designed to operate in, one would not be violating the law.
