I have a xd-40 and I just bought a firedragon 9mm conversion barrel. Now if I use my existing .40 mags it will fit 14 rounds of 9mm ammo, is this legal to do? Is it legal for me to use my .40 mags in this scenario? Someone told me that as long as the mags were altered then it's legal, but I just want to get clarification on it before I take it to the range.

This topic has been discussed before. Here is the link: http://www.calguns.net/calgunforum/s...ght=extensions
So long as you did not modify the XD40 10 round mag by adding a different follower, extension, floorplate, etc and left it completely stock from the package, you can use it in the 9mm.
Here it is discussed on ARFCOM: http://www.ar15.com/lite/topic.html?b=5&f=34&t=13358Psalm 144:1 - "Praise be to the LORD my Rock, who trains my hands for war, my fingers for battle."Comment

Just a side note...i was not able to get my .357sig or .40sw XD mags to reliably feed 9mm rounds in factory form both required some tweaking and tuning of the feed lips to allow for proper placement in the mag.
I ended up just picking up some 9mm mags after getting tired of screwing with feed lips all the time.Comment

Problems getting the XD40 mags to feed the XD9? I only use 40 cal mags in my XD9. The only problem I ever get is sometimes it goes to slide lock with one still in the mag (14 shots instead of 15). Just a little tap on the mag and it is good to go for 15. When I'm just plinking, no problem just using the factory XD9 mags.
As far as the P99, I use cheap 40 cal Promags and they work fine.Last edited by AfisBoy; 08-19-2007, 1:38 AM.Comment

When I used xd 40 mags in my 9mm I pinched the feed lips in slightly(20,000ths of an inch) where the mags would work in both calibers and the slide didn't lock back with one round in the mag. Shot matches with those mags and they always worked. MarkComment

As mentioned, been discussed before and I sent an email to DOJ regarding tweaking the lips and see DOJ's answer below.
Answered by Ms. Leslie McGovern on Dec. 5, 2005:
"If you are tweaking the lips to make it fit, then you are manufacturing
a large cap magazine."
I asked another question on Dec. 11, 2005:
"As I mentioned, there are other 40 S&W magazines that
does not have to be tweaked, will it be a violation of
the law to put 15 rounds of 9mm in that particular 40
S&W magazine? Since the lips are not tweaked I would
assume this will not fall under manufacturing. I wish
I could get a straight answer from your office.
And Ms. Leslie's answer on Dec. 15, 2005:
"This is in response to your email of 12/11/05 questioning the legality
of placing more that 10 rounds (9mm) in a .40 S&W 10-round magazine. I
asked our law enforcement counterparts here in the Firearms Division
how they would view such a magazine vis-a-vis the high capacity magazine
law.
I was told that if an agent encountered the above situation, they would
arrest the possessor of the magazine because he would be in conflict
with Penal Code (PC) 12020(a)(2) for manufacturing a high capacity
magazine (see 12020[c]25) for high-capacity magazine defined). In placing
more than 10 rounds in the magazine, you are considered to be
manufacturing a high capacity magazine.
Penal Code section 12020: "(a) Any person in this state who does any
of the following is punishable by imprisonment in a county jail not
exceeding one year or in the state prison: . . .
(2) Commencing January 1, 2000, manufactures or causes to be
manufactured, imports into the state, keeps for sale, or offers or exposes for
sale, or who gives, or lends, any large-capacity magazine. . . .
(25) As used in this section, "large-capacity magazine" means any
ammunition feeding device with the capacity to accept more than 10 rounds,
but shall not be construed to include any of the following:
(A) A feeding device that has been permanently altered so that it
cannot accommodate more than 10 rounds.
(B) A .22 caliber tube ammunition feeding device.
(C) A tubular magazine that is contained in a lever-action firearm."
15 rds should fit.Originally posted by neomentatNow if I use my existing .40 mags it will fit 14 rounds of 9mm ammoComment
