    Intratec AB10 question


    a shooting buddy of mine is thinking of moving out from Virginia- can she break down her AB10 to legally bring it with her; then bullet button a 10 round mag into it once here? Or should she Californicate it before driving in?

    1. If she does not install a BB-style maglock before entering CA, she is importing and possessing an illegal
      unregistered assault weapon. Multiple felonies. (And I am unclear as to how/if the AB10 could be imported
      disassembled and not be regarded as an AW, given the nature of its construction/design.)

      She needs to install it/test it before crossing the CA border. She should be familiar with the parameters
      of 12276.1PC and the definition of detachable magazine and understand and be able to reliably
      verbalize WHY it's not an AW.

      Younger people with tattoos seem to have more interaction with LEs for any of a variety of reasons,
      so better preparation is key to avoiding drama.

    2. She should ensure the BB-style maglock is installed & working properly and will not loosen and end up
      in "failing-to-illegal" status.

    3. She can't import assembled hicap magazines unless she perchance owned/possessed 'em in CA before
      1/1/2000 (very unlikely for her).

    4. Within 60 days of moving into California/establishing residency, she has to file a New Resident Handgun
      Ownership report with CA DOJ Firearms Bureau (see website; $19 fee, can't remember if it's per gun or
      not) for any handgun(s) she's bringing in. (Long guns do not require this, but no AWs can be brought
      in; they need to be not banned by name and not have evil features or have BB maglocks installed, etc.)

      The issue with doing this is that "Intratec AB10" may ring some bells in the DOJ as an AW, and they may
      contact her and ask to inspect the gun. She should be prepared for possibility of some interaction and
      to maintain the gun in a legal state - and also that there's no other issues in her life that might have
      issues if LEs start getting involved.

      This again is unlikely, but it has happened, and there appear to be various DOJ folks rotated around that
      don't always know what they're doing.

      Tell her she should NEVER consent to search. If she's legit, CGF will back any issues she has.
