    XD .45 ACP, legal?

    Hey everyone,

    I'm a new member, and am pretty psyched about this site. well I've just recently purchased a Springfield XD .45 ACP 4" barrel service model, when I got it i didn't even think of asking about the legality of the weapon in California. The case that i got it in states "NOT LEGAL IN CALIFORNIA". the Question is; is that true and if so can someone explain to me why or point me in the direction of the answer? See im from CA and in the military but presently stationed out side CA and would like to go back one day with my XD and future purchased firearms. Thanks for the help.

    from what i`ve seen that xd45 is cali legal.but if your mags are more than 10 rounds,they arent cali legal.

        Its good to go here in CA
        I have one myself, bought here in San Jose.

        By law, IIRC, you will have to register your handgun(s) when you move back into California.

          It's the magazines that are CA-illegal. They just put "Not CA legal" on the case at the factory when they're making up the packages with 13rd mags and the CA-legal ones with 10rd mags.
          If you're not a resident of California, please don't waste your time trying to sell handguns here. A: your handgun is not on the approved list, and can't be sold here or B: We can already get it here with less hassle.

            The XD 45 is LEGAL in California. As wutzu has stated, just the high cap mags (over 10 rounds) is illegal in California. You can still buy the gun, but just won't get the mags with it.

              The XD you have's case said that for one of two reasons. A) It has factory night sights, or B) It came with Hi-cap mags. As long as the mags were switched out by the distributor or dealer for CA-cap 10 round mags you are good to go. The XD-45 w/ Night sights was originally feared to be not CA legal so SA labeled them as such, they later received word that those pistols were fine on the standard XD-45 approval ticket. I'd bet good money your pistol was the latter, since those are the only ones I've seen with marked cases. Pull the sticker off the box and never worry about it again.

                Its common for dealers to buy handguns without high cap mags from distributors and then swap the high cap mags that come with them for 10 round mags. Its the easiest way to get in on good deals on guns from distributors.

                    XD45 BI-TONE (XD9613) is NOT on DOJ list. it's NOT LEGAL in california. i've been waiting for awhile now. other version are good to go as long as it's not over 10 rounds

                      What you mean is that a CA resident cannot buy this gun or have it imported into the state, right? It is legal for a non-CA resident to buy it while living out of state, and subsequently bring it with him when he moves to CA provided he doesn't bring any 10+ mags with him. This is about the only way non-listed handguns can legitimately get into CA. They do have to be registered once they are here. Somebody correct me if that's not correct.

                          Right, it's not legal to PURCHASE in California, but it IS legal to POSESS in California if it was purchased while living out of state, and brought with you to California when you moved to CA, provided it is subsequently registered and you did not bring any 10 round magazines. I believe that was the question posed by the original poster.

                          That assumes one was a non-CA resident when the purchase was made. I think we all know you can't go on a weekend trip to Las Vegas or Reno and come home with a new pistol (at least not legally!). You have to actually be a resident of the non-CA state. Different states have different quals for being considered a resident, and that's a whole nuther kettle of fish. There are some techincal exceptions for C&R holders even on that score, if I'm not mistaken, but as a general rule, verbotten.
